There is now no reason lor disquietude on thisBCore. Mr. Mason had tho good fortuno to bo made the head of tho Tax Commission. Tho Intelligencer did not favor this appointment, and, to bu frank, was not consulted about it by the appointing poiver. It was Mr. Mason'b intention to use the Tux Commission /or the purposes of the certificate syndicate, and that is what ho is doing now. His pamphlet is part of his general campaign,and whoever reads it must read it in that light?as emanating from the agent ol people who hold very insecure oecuritiea and are desirous of realizing on them. When ho paints a dismal picture of growth retarded by reason of the certificates, he is eiinply advocating his clients, cause and trying to get "both legs into the jury box. The point of "Young Fogy'o" articlo ia that the executive department haa no right to interpret, nullify or obstruct a law, and the writer used nearly a column of the Reaitter to show that this was what the executive department hod done in the mattor of the tax exemption law; that was thegravamon of hia charge; that is what the peopl? complain of; it ia the argument in support of this charge which the Intelligencer believes to be unanswerable. It ,may bo that the law is unconstitutional. That ia not tho burden of "Youug Fo^y'a" article; that point was not touched on in tho Intelligencer's article; and that is not tho point in controversy. "Young Fogy," who believes tho law to be unconstitutional, declares that "the validity of that law has never been called in question befqre any judicial tribunal." It follows that the executive act was an act of usurpation. And iuriher "Young Fogy" says: "I do not deny that the Governor is honest f in hte opinion that section -13 of chapter 12 of tho acta of 16S1 is unconstitutional, but it haa not been declared bo because that act haa not been before the courts. The Legislature haa expressed its decision in favor of its constitutionality. The Governor virtually did bo when he approved it. It standa on tho statute books unrepealed and uncontroverted." This has been and i* the position of tho Intelligencer, maintained, doubtless, with much less ability.
