Judso Cnldwoll Dooldoa tho Uulon PnolOo Wnffo Omo, THE RECEIVER'S ACTION MOT LEGAL Thoir IlequcMt lor u Koiluotlnit ol Wngca .Mailo Ignornntly anil llio Cnso of tlio Employncn Decided Favorably?A Better Way lo Scttlo ft Wngo Dispute Tlittn to ltcNort Co Forco. Omaha, Num., April 5.?Judgo Cald woli'a decision in tlio Union Pucitlc wngo Bohedulu case was rondorcd to-day. It was a comploto victory for tlio em ployees. After atating tho facta ot tho road coining into tho lunula of the receivers, Judgo Caldwell snys: Tlio relation of theso men to tho com pany and tlioir rato of vrnges wero do terminod in tho main by certain written rules, regulations und schedules, eomo ol which had been in forco for more than a quarter of a century und all of which had boon in forco substantially as they stand to-day, for n period of oight years and more. Those rules, regulations nnd rcltedulea wore tho re sult of froo and voluntary conferences hold from tirno to tiruo botweon tho managers of tlio railroad and tho olli cera und representatives of tho sevoral labor organizations representing tlio uinn in tho dilloront sub-divisions or branches of tho sorvice. Tlioio labor organization?, like tho rules, regula tions and schedules. had bocome estab lished institutions on tho system many years beforo tho appoiutment of tho receivers. Among tho rules and regulations ro forred to and in operation when tho ro coivors woro appointed was ono to tho ollect that no change should bo mado in tho rules and regulations and tho rate of wages without lirst giving to tho labor organizations whose members would bo affected by such chango thirty days notice, or other reasonable notice. Judge Caldwell then rocitcs how tiio roceivers went into court last January to force a reduction on tho scheduio of wages, nnd states all tho legal steps taken down to aud including tho hear iug just ended. Judgo Caldwell then coes on to eay that when a court ol equity takos upon itself tho conduct anu operation of a great lino of railroad, tho men engaged in conducting tho business aud operat ing tho road become the employes of the court, and are subject to its orders in all matters relating to tho dischargo of thoir duttea and entitled to its pro tection. ? It is the court's belief that tho re ceivers mado tho request for a reduc tion ignorantly, ?s oulv one of them is a practical railroad man, and their opinions upon tho eubject of wagos schedules is confessedly of littlo value. Ill ere would seem to* bo no equity in reducing tho wagoa of omployos below what is rcasonablo and just in order to pay dividends on stock and intorest on bonds. The rooommendatiori of the re ceivers to adopt their, schedules cannot bo accepted bv tho court for another reason. Thnt scheduio was adopted without allording to the men or thoir representatives any opportunity to bo heard. When property is in tho custody of receivers tlio law doclaros it to bo a con tempt of tho court appointing them for any person to intorforo with tho pro perty or with the men in their ornploy. No injunction order can mako such un lawful interference more than law makes.it without such ordor. Such orders havo an injurious tend ency becauso they tend to creato an im pression among "the men that it is not an oflenso to interfero with proporty in tho possession of recoivers or mon in their oraplov unless they havo been specially onjoined from so'doing. This is a dangerous dolusion. To the extent thnt a special injunction can go in this class of cases tho law itsolf imposes an injunction. For this reason no injunc tion will be ontored in this cose. TO TAX (JltKKNUACK*. A Slgnllli-nut Ultl?Iim Object Kxplnlttcd by air. Hull. Washington, 1). C., April 5.?Hepro Bontativo Ilnll, of Missouri, who was dolonatod by tho commitloo on banking and currency to writo tho favorable ro port on tho Cooper bill to lax green backs, said concerning tho bill: "I regard tho rncafluro as a moat sig nificant one. Tlio greenback was orig inally the peoplo'n money, but of lato it has become lha pet of national banks. They havo kept it from circulation, as its Ircodom from taxation made it inoro dosirublo to keop in tho bank vaults than silver or gold. Tho anxiety of tho hanks to get hold of greenbacks hits been so irreat that a fraudulent practice has grown tip. Thoro are only $34ti,000, 00(1 of greenbacks in circulation, yet official returns show that banks and in dividuals claim exemption in three bil lions of greenbacks. Tho manner of conducting tho fraud is simple. A pack ago of greenbacks is passed from bank to bank ahead of tho tax nssosaor, and at each bank ho exempts tho satno Dnckago of greenbacks. Tho Cooper bill will put an end to this practice. "As aflectinc the currency question in general tho bill is also important. At present coin money is subject to tax ation, and as silver is the coin in great est circulation, silver bears tho greatest burden of taxation. This moasuro will relieve silver from one of tho many un just discriminations niado against it. 'apor money will pay tho Bamo tax as ilvor, and "thoro will bo no further reason for denying silver access to tho banks and general circulation because of tho present pecuniary advantage of securing greenbacks. Tho bill will most undoubtedly puss. It has twice passed tho eenato by an unanimous vote, and it is in most of the Democratic state plat forms." A Gigantic .Scheme Proposed.
