And eny manufacturer of spirits, refin ed coal oil or other oil, tobacco, cigar* or other arti cles which may by law be r?-quired to be inspected, who shall refuse to admit an inspector npon his pre miees, so far ae may be neceesary for the performance. of his duties, or who shall obstruct an inspector in the performance of his dutlee, .hall forfeit the sum of one huudred dollars, to recovered in the manner provided for otber penalties imposed by this act. gee, 59. And be it further enacted. That all spirits distilled as aforesaid by any person licensed a* afore said shall, before the same are used or removed for any purpose, be inspected, guaged and proved by gone inspector appointed for the performance of such duties, who shatl mark upon the cask or other pack age containing such spirits, in manner to be prescrib ed by eaid Commissioner, the quantity and proof of the contetts of such cask or package, with the date of inspection and the name oi the Inspector, and shall make a return of all spirits so inspected, and the name of the distiller, to tne collector, an J a da plicate thereof to the assessor of the district; and the dutj impoatd bj Uw ?b.ll b. f-id on .ll.plrlu so inspected aod not removed forthwith to a bonded warehouse. Aud any person who shsll attempt fraudently to evade the peyment of dutlee upon any spirits distilled as aforesaid, by changing in any manner the mark upon any such cask or package, shall forfeit the sum of one hundred dollsrs for each cask or package so altered or changed, to be recov ered as hereinbefore provided. And any suoh in spector whs shall knowingly put upon any such cask or package any false or fraudulent mark shall be lia ble to the same penalty hereinbefore provided for each ce** or package so fraudulently marked. And any person who shall purchase or sell any empty cask with the inspection marks thereon, or who shall < fraudulently use any cask or package so marked, for the purpose of selling any other spirits than that so Inspected or for sell ng spirits of a quality or qusn- i tity different from that so inspected, shall be subject to a like penalty for each ca?k or package so pur* ohaaed. sold or used. Bee. 60. An?l be it farther enacted, That the own er or owners of any distillery or oil refinery may provide, at his or their expense, a warehouse, in conformity with such regulations as the Secretary ol the Tr?*-^lry may prescribe; and such warehouse, ^*heu approved by the collector Is hereby declared a bonded warehouse of the United States, and shall be used only for strong distilled spirits or refined coal oil or naphtha, and to be tinder the custody of the collector or his deputy. And the duty on the spirits, coal oil or naphtha stored In such warehouse ?bail be paid before It Is removed from such ware house. unless removed in pursuance of law. Sec. 61. And be it further enacted. That all distill* ed spirits and all refined coal oil and naphtha, upon which an excise duty Is Imposed by law, may, after being inspected, ganged, proved aud marked by the inspector according to the provisions of this act, be removed, without payment of the outy, under such rules and regulations, and upon the execution of such transportation bonds or other security as the Secre tary of the Treasury may prescribe. The said spir its, oil or naphtha so removed shall be transferred directly from the distillery or refinery to a bonded warehouse, established In oooformlty with law and treasury regulations, and may be transported from such warehouse to any other bonded warehouse used for the storage of distilled spirits, coal oil or nsph* tha. And after the arrival of such distilled spirits, coal oil or naphtha, at the bonded warehouse within the district of the asseesor to which it has been trans ferred, it shall be again inspected, and the duty shall be assessed and paid on any deficiency or reduction of the number of proof gallons beyond such allow ance for leakage as may be established by the regut latlons ?f tho Commissioner of Internal Revenue, re oelved at the warehouse, from the number of proof gallons as stated In tho bond given at the place of shipment. And any d'stllled spirits, coal oil or naph tha in the public warehouses shall be subject to the same rules and regulations, and be chargeable with the same costs and expenses In all respects to which imported goods deposited in public store or bouded warehouse may be subleot; aud shall be in charge of a proper officer, to be designated by the Secretary of the Treasury, who, with the owner and the proprie tor of the warehouse, shall have the joint custody of all the distilled spirits, oil or naphtha so stored in said warehouse, which shall be at the risk of the owner of the said spirits, oil or naphtha. And all labor on the same shall be performed by the owner or proprietor cf the said warehouse, under the su pervision of the officer in charge of the same, and at the expense of said owner or proprietor of the ware house. And no drawbsck shall in any case be allow* ed on any distilled spirits, coal oil or naphtha, upon I which an excise duty shall have been paid, either I before or after it shall have been placed in a bonded [ warehouse: Provided, That any distilled spirits, coal oil or naphtha may be withdrawn from the bonded warehouse after pajment, to the collector of Inter nal revenue lor the district in which the warehouse Is situated, of the duty impesod by law, or may be removed without payment of the duty for the pur pose of being exported or for the purpose of being redistilled for export, after the quantity and proof of' the spirits, oil or uaphtha to be removed has been ascertained and inspected according to the provisions of law, under such rules and regulations and the execution of such bond or other security as the Sec retary of the Treasury may prescribe. And any spirits, oil or naphtha so removed for distillation shall be returned to the warehouse and shall be again inspected and the duty shall be paid to tbe said col lector on any defioiency or reduction beyond the al* lowaooe lor loss by redistillation established by the Commissioner of Internal Revenue, In the number of proor gallons received at the warehouse for the purpose of being exported, as aforesaid. And noth ing in this section shall be construed to prevent the manufacture for exportation, without payment ef duty, of medicines, preparations, compcstttons, per fumery, cosmetics,cordials and other liquors manu factured wholly or in part of domestic splits, as provided for in this act. Bee. 63: Aud be be it further.enacted. That the entries required to be made in tbe books of the dis tillery as aforesaid, shall, on the first, eleventh and twenty-first days of each and every month, or with in five dsys thereafter, be verified by oath or nfflr* instion, of the person or persons by whom such en tries shall have been made, which oath or aCrma tion shall be certified at the end of suoh entries by the aeeeesor or assistant asseesor or officer adminis tering the same, and shall be, in substance, as fol low*: *'I do swear (or affirm) that the foregoing en tries were made by me on the respective days spec!- | fled, and thst the> state, according to the beat of my knowledge and beiiet* the whole quantity of spirit nous liquors distilled and sold, or removed for con sumption or sale, at the distillery owned by , in tbe county of .amounting to??gallons^ accord ing to proof prescribed by the laws of the United States." Sec. 63. Sec. 64. And be it further enacted. That there shall be paid on all beer, lager beer, ale, porter and other similar fermented liquors, by whatever name such lianors may be called, a duty of one dollar for each and every barrel containing not more than thirty one gallons, and at a like rate for any other quanti ty or for fractional parte of a barrel, which shall be brewed or manufactured and eold, or removed for consumption or sale within the United States or the territories thereof, or within DUirictof Columbia; which duty shall be paid by the owner, agent or su perintendent of th. brewery or premises In which such fermented liquors shall be made, and shall be paid at the time of rendering-the accounts of sneh fermented liquors so chargeable with dut?, u here inafter required: Provided, That bar.Uooal parts of a barrel shall be halves, thirds, quarters, sixths, eighths sod sixteenth*; and any-fraction*! part eon* taining leas than one-sixteenth shall be accounted one-sixteenth; more than one-aixteenth and not more than one-eighth, shall be accounted one-eighth; more than one-eighfll and not more than one ajxtn, shall be accounted oae sixth; more than one-sixth, and not more than ?ne-qaart^r, shall one-quarter; more than one-qoarter and not more than one-third, shall be accounted ooe-thfrd; more than one-third and do? more tbmn one-half, sliaU be accounted one-hal/;. a^ore than onsuhalf oounted one barrer.
