Georgia, respectfully showeth, that on tho 16th day bl
October, 186S, ho was, by force of arma and without le
gal warrant, seized and Imprisoned at Augusta, by a
guard of United States troops, In obedlenpe, as he was
Informed and believes, to a tologram sent to tho Post
Commander at Augusta, by Col. Brown, of the United
States Army, commanding the Post of Anderson, in the
State of South Carolina.
That your petitioner was carried under guard of the
troops of tho United Btatos, from Augusta to Columbia,
in tbo State of South Carolina, and there illegally and
without dne process of law Imprisoned under guard of
the troops of the United States, upon the charge of hav
ing boon conoemed In tho murder of three United States
soldiers, at Brown's Ferry, in Anderson District, In the
SUte o? South Carolina.
That on tho llth day of November, 1866, your peti
tioner was, without due process or law, but by order or
the military authorities of the United States, removed
to Charleston, and there Imprisoned by order of and
under the guard of the military authorities or the
United States.
That on the-of-a Military Commission was
convened by order or Major-General Sickles, United
States Anny, commanding the troops or the United
States in the State of Bobth Carolina, aa will appear by
a copy or said order, hereto annexed, as exhibit "A."
That on the-day of - your petitioner woe ar
raigned before Bald Military Commission, on tho follow
ing charges and speolBcaUons.
CHAROS I.-Attacking with armt, forcing and over
coming a guard of the military for?a of the United Statet.

In this, that he. Francis O. Btowers, a citizen of Geor
gia, actuated by hostility to the United BUtes, and with
intent to oppose Its military forces, did voluntarily as
sociate himself with an armed band, and acting there
with, did, with unlawful force and anna, attack, force
and overcome a certain guard detailed and on duty at
Brown's Ferry, in the Stat? of Sooth Carolina, under
the authority or the President of the United- States,
Gommander-in-Ohirf.of the Army and Navy thereof, and
did kill by shooting' with pistols, or with other fire
arms, and by drowning in the Havannah River, Corporal
W. O. Corbett, Private Emory Smith and Private Mason
Brown, all'of Company "A," First IJattallon Maine
Veteran Volunteers, United States Army,' all dnly enlist
ed soldiers of the United States, constituting the said
guard. ,

thought, kill "with a pistol or other -weapon, and by
drowning In the Bavancah River, Corporal W. O. Cor
bett, Private Emory Smith nod Private Mason Brown,
all of Company "A," First Battalion Maine Veteran Vol
unteers, United Btates Army, all dnly enlisted soldiers
of the United State?, the said soldiers being then on du
ty as a guard at Brown's Ferry, in South Carolina.
All this, at or near Brown's Ferry, Anderson District,
South Carolins, on or about the night of the 8th of Octo
ber, leCS.whlle Martial Law was in force by the authori
ty or the President or the United States, Commander
in-Chief of the Army and Navy thereof.

SPECIFICATION.
In this, that he, Francis G. Stowers, a citizen of Geor
gia, did, in company with other citizens, and being
armed with a pistol or other offensive weapon, felonious
ly asp ault Corporal W. C. Corbett, Private Emory Bmitb
and Private Mason Brown, all of Company "A," First
Battalion Mame Veteran Volunteers, United 8tates
Army, all duly enlisted soldiers of the United States,
the said soldiers being then on duty as a guard at
Brown's Ferry, in the Stato of Routh Carolina, and did
feloniously pnt tbem, the Bald Corbett, Smith and
Brown, in fear and danger of their lives, and did felo
niously and violently steal, take and carry away from
the persons, and against tho wills of them, tho said Cor
bett, Smith and Brown, certain goods, to wit : Arms,
accoutrements, horses, and one pair of boots.
AU this, at or near Brown's Ferry, Anderson District,
South Carolina, on or about the 8th of October, 1805,
while Martial Law ?rat ia force by the authority of the
