try. I think that this motion can moet with no
opposition from the prisoner's counsel. On behalf
-ortho Government, I would suggest that all tho
branches of tho Govorument should aot in unison,
and that the judiciary and the military should not
have- tho appearance of acting in opposition to
-each other. We have jast passed through a torri
'blo war, to use no harehor word, andtheolemonts
aro just settling down. I move, thorefore, that a
rulo to show cause be granted, and that it be mado
returnable on Thursday week.
Gon. Conner rose and addressed the Court in
Toply, as follows :
Tho motion of the District Attorney involves him
self, the Court, and ourselves in embarrassment. It
is indeed a singular proceeding that, aftor an order
has been issuod and an attachment served under
. it, that a motion should be made to set aside tho
i? i uiii to the attaohmont and issue a different order
iiinUiiid. This is a proposi ion to consider whether
tho order for attachment should have boon mado at
all. That question cannot be made without cause
shown. Now no reason whatever is given for this
motion. It is made, too, without any authority
fri-tti Gen. Sickles. If Gen. Sicklee will canee the
jjrJBoner8 to appear, we will drop tho whole pro
ceeding in attaohmont. We do not care about the
attachment. We wish the prisoners to bo pro
duced and a fair trial to be given them. The rule
asked for cannot issue now. What right have we,
and, with all due deference, we would ask what
right has the Court to keep the prisoners in jail
for ton days ? The question is, shall the authori
ty of the military prevail over tho liberty of the
- citizen ? Ten days have already passed sinos the
writ was issued. The oaao has been already
-twicA postponed, and tho Court is now asked to
modify its rulings, and reverse its judgment, and
all I he timo to keep the prisoners in jail. The
'return to the attachment mast be made. If Gen.
biokles in willing to produce the prisoners, there
oiiti he no difficulty. We must, therefore, on be
half of the prisoners, oppose the motion of the
Dint.t iut Attorn ey.
Judge Bryan then gave his decision as follows :
I would have been very happy indeed if this
motion had been made before; but I regret ex
ottiitliiigly that it is now too late. I had not sup
pu.iuil that Gen. Sickles had meant to commit a
deli orate con tempt against the authority of this
-C'luii, but now I am lofe no liberty to doubt that
he iiaa taken isaue with this Court, and that he
in; nda to depondupon the military authority as
bi.i? i i ir in the constitution and law of the land.
I litvo never questioned his oandor and good
faith, mid good disposition to this Court and to
the people. The issue, however, has heon made
between the military authority and the liberty of
the citizen, and I must accept the issue. With
the greatest respect for Gen. Sickles, I regret that
I urn forced to make tho decision wbioh Ido make,
and that I cannot accept the motion of the Dis
trict Attorney.
Tho District Attorney explained that he had
mado tho motion after serious consideration of
-?what was his duty in the promises, and that, not
having heard any return read, though he con
fessed bo knew what the return was, he thoaght
it not too late for a reconsideration.
Jud-e Bryan expressed himself obliged to the
Dis!riot Attorney.
Hon. Ar-tistead Burt then moved that, with a
view to further proceedings, the return of the
Marshal be read, which Hit* accordingly dono.
The return stated, in mi not anco, that the Mar
shal had served the attachment on General Sicr
*__8, and that he had refused to bo arrested, and
had endorsed his refusal on the back of the war
rant, putting it on the ground of orders from his
superiors.
Hon. Abmtstf.ad Burt then addressed tho Court
as follows :
On hearing thin return, wo suggest to tho
Court that a certified copy of the \ r o coo dings
already had in Hub oaau be forwardod to the
President. The issue is now clearly made. A
mero agonoy of the Executive Department of the
Government takes issue with the Judicial Depart
ment. Tho Court has exhausted the power con
ferred on it by tho Constitution. Ibis powerless
to do anything further without an appeal to ar?is.
Wo regret exceedingly that the distinguished ofli
oer, to whom the mandate of the Court waa di
rected, has thought fit to preclude the argument
of great quoationa ?that ho has proforrod to re
fuso to obey this Court. We had designed to hold
a debate with tho military?wo had designed to
know and ascertain whether the military authori
ty is superior to the civil in a time of profound
peace, and whether we live under n- military des
potism, or uudor tbo government of the law. This
question has been precluded. We consider that
tuero is but ono courut- loft to the Court, and that
is tho one we have suggested. I submit respect
fully and humbly to the consideration of the
Court, that it must feel itself compelled to inform
tho President of what has been done, and there
fore respectfully Bubmit the motion already
mado.
Judge Bryan then spoke as follows :
There is no alternative left this Court. Its
fiowor ?a only moral. It represents the oonstitu
ion and the law. If not upheld by tho co-ordi
nato branches of the Government, and sustained
by the people, it is powerless. It depends upon
tho love or liberty and the sense of right in the
fjreat heart of a free people. It has no bribe to
nduce, nor army to compel obedionce; and when
the army, which is its natural ally and servant
become? its opponent, it loses the strong arm on
which it rightfully and legally dependa. Ifeel that
I have exhausted the powor of the Court. I have
attonded to my duty, and met the question in the
love of libertv and right. I have perfeot respect
for Gon. Siokles, and am glad to suppose that he
also acts under the impression that he is right.
I am satisfied that I have done my duty in the
love of right, and trusting in the triumph of
right, and I cannot normit myself to doubt the
result. The cause of right is holy, and it I dos
pair of its success I must despair of the libortiea
-of my country. I will be glad if a statement is
prepared according to the suggestion of counsel,
and I will give it any ondorsoment in my power.
Hon. Abmibtead Bort suggested that tbe Mar
shal amend his return by statiug that, having no
power to enforce tho arrest, he withdrew it; which
was accordingly done.
Hon. _. Bum* stated that he would bring to the
notice of tho Judgo at Chamber*-, the Act of Con
gress on which tho return in tbo case of Stowers
Was based.
J. B. Cami'hell, Esq., moved a continuance of
the case of M. Costkllountil Monday roxt, which
was granted.
On motion of tho Distriot Attoruoy, the Oourt
Adjourned.
