Tho following are the ^feeing
scenes of the Sirrratt trial: At 1
o'clock, tho prisoner was brought
into the court room, and assigned to
the seat occupied b^'hlm during the
trial, beside bis counsel. He came
into court smiling, and seemed in
good spirits, as ho" chatted with his
counsel. Merrick made au allusion
to the report that an attempt would
be made ut rescue, whereat the pri?
soner seemed much amused. At rive
minutes past 1, Judge Fisher re?
sumed his, seat upon the bench, and
the jury'Were brought in. By this
time, thet room was much crowded. ,
TbUi.fOremnh stabed that they were
unable to agree, and handed Judge
Fisher a letter to that effect. The
Judge stated that he had received
several letters of a similar character,
and as there seemed no possible
chance bf ? verdict from this jury, he
would discharge them. This -was
objected to by Mr. Bradley, but the
objection was overruled. Judge
Fisher then stated that as Mr. Brad?
ley had, on the 2d of July, daring a
recess of the conrt, used insulting
and threatening language towards
him, ho ordered his name to be
struck from ? the roll of attorneys.
On the adjournment of the court,
Bradley followed Fisher and handed
him what waa supposed to be a chal?
lenge, but it proved to be only an
acceptance of a verbal challenge
given by the Judge during the trial.
The dilemma is this: If Bradley is
{mnisbable for accepting, Fisher is
iable for sending a challenge, the
punishment for which is fine and
imprisonment for five years. The
interest in the Surratt trial yields to
the Fisher and Bradley quarrel.
