SIONERS OF BARNWBLL TO COKBTBUOt A J Alli AT BLACKVILLE, TUB COUNTY SEAT. SECTION 1. Be it enacted by Ute Senate and Home of Representatives of the State of South Carolina, now met and silting in General Assembly, and by the authority of ike same. That the County Commission? ers of Barnwell County be, and they are hereby, required and directed, immedi? ately after the passage of this Aot, to I cause to be constructed a jail for the use1 of said County, at the town of Black? ville, the. County ?eat; the said jail, when completed, with the highest prac? ticable security for tho custody of pri? soners, not to exceed in cost the sum of eight thousand dollars. SEC. 2. The said Commissioners are authorized to advertise for plans and specifications, and proposals to build said jail, in the newspapers published in Barnwell, and in one daily newspaper published in Charleston and Columbia, for the space of three weeks, and from the plahs, specifications and proposals submitted to select such one as they may think best adapted to the necessities of a jail; and they are further authorized to contract with the party submitting tho plans, sp?cifications and proposals ac? cepted by them. ' SEO. 3. On the completion of said jail, according to contract, and. after it?shall have been approved and received by tho said Commissioners, they shall be au? thorized to draw upon the County Trea? surer of Barnwell in favor of the con? tractor for the amonnt agreed to be paid therefor, which draft shall be paid by the Treasurer on presentation; but the said Commissioners are authorized, in their discretion, to stipulate for payment to the oontraotor in instalments as the work progresses: Provided, Thatnosuoh payment shall be made except upon an estimate furnished in writing by the oontraotor, and carefully examined by the Commissioners, showing the amount of work actually done, and of material aotually furnished, at the date when pay? ment is asked: And provided, further, That there shall be reserved of snob esti? mates twenty oents per. centum, which shall not be paid to the oontraotor nntil the jail shall bo completed according to contract, approved and received by the Commissioners. And the said Commis? sioners are authorized to draw npon the County Treasurer for all amounts thus agreed to be paid, which draft the Trea? surer shall pay upon the filing with him the estimates npon which such drafts are drawn, endorsed with a certificate of ap? proval Bigned by the said Commission? ers, or by a majority of them. BEC. 4. The County Treasurer shall set apart the sam of eight thousand dol? lars from the County funds, and hold each sums subject to the drafts of the County Commissioners for payment for materials and oonstrnction of said jail: And provided further, That that part of the County of Barnwell, which, with Eonions of the Counties of Edgefield, lexington, Orangeburg, now forming the County of Aiken, shall not be liable in any way for any debts contraoted in building a jail at Blackville, in accord? ance with the provisions of this Act.
