AN A OT TO AMEND THE LAW IN RELATION
TO THE LICENSE AND REGISTRATION OF
PHARMACEUTISTS, APOTHECARIES AND
DRUGGISTS, AND TO REGULATE THE
VENDING OF DRUGS AND MEDICINES.
SECTION 1. Be it enacted by the Senate
and House cf Representatives of the State
of South Carolina, now met and sitting in
General Assembly, and by the authority of
the same, That from and after the pass?
age of this Aot, the Medical Faculty of
tho University of South Carolina shall
possess and exeraise all the powers here?
tofore given and now possessed by the
Faculty of the Medical College of
Charleston, in respect to the examina?
tion and license of pharmaceutists, apo?
thecaries and druggists: Provided, That
this section be construed as in no wise
diminishing the powers of the Faculty
last named; but as giving to the Faculty
first named the same powers, and also
imposing thereon the duty and obliga?
tion to exercise suoh powers upon due
application.
SEC. 2. That any pharmacoatist, apo?
thecary or druggist who carries on and
conducts the business of sach occupa?
tion in thia State, after the expiration of
six months from the passage of this Act,
must have a license therefor from one of
the above named bodies. And any per?
son who shall thereafter carry on and
conduct the business of said occupations,
or any of them, without such license,
shall be liable to indictment as for a
misdemeanor, and, on conviction, to a
fine not exceeding five hundred dollars,
or imprisonment, not exceeding six
months.
SEC. 3. That before granting said
license, except in the cases hereinafter
excepted, each applicant therefor shall
undergo an examination by and before
that body to which the application is
made, and of suoh nature as they shall
require; but suoh examination must in?
clude the reading of manuscript pro?
scriptions and oxplanations thereof, the
discovery or detection of unusual doses
of drags, and especially of poisons, the
recognition and distinguishing of the
various roots, barks, leaves, fruits, rosins
and gums, in oommon use, and the pro?
per antidotes and mode ?of administra?
tion thereof for the different poisons.
SEC. 4. That no oxamination shall be
required in case tho applicant is a regu?
lar graduate in medicine or pharmacy of
a school that is on tho ad enenden of the
University of South Carolina, but such
an applicant shall bo entitled to a
license, upon furnishing evidence of his
graduation satisfactory to the said Fa

SEC. 5. That it shall bo tho duty of
the Medical Faculty of tho said Univer?
sity to establish, carry on and preserve,
in a book to be kept for that purpose, a
register of all pharmaoeutists, apotheca?
ries and druggists iu the Stato, including
the names of persons registered, place of
business, the fact whether the person
registered be a graduate of medicino and
pharmacy, or whether under lioonse
granted on examination, and any other
nutter of information the said Faculty
may see fit to add.
SEC. 6. That it shall be the duty of all
licensed pharmaceutists, apothecaries
and druggists, by whichsoever body li?
censed, to have their names registered in
manner aforesaid by the Medical Faculty
of the University of South Carolina,
and to report annually on or before the
first day of November of each year, to
the said Medical Faculty of the said
University, whether nay, and if any,
what change has occurred within the
then preceding year, as to their respect?
ive places of business; and for omission
or negleot of tho requirements of this
section, or any of them, they shall, re?
spectively, incur a fine of twenty-five
dollars; and for each and every registra?
tion or change thereof, the party so re?
gistered shall pay to the said Fucnlty of
the University the Bum of one dollar,
whioh shall be their compensation for
tho services performed in accordance
with the provisions of this Act.
SEC. 7. That it shall be the duty of
the Medical Faculty of tho University of
South Carolina to make a correct roport
to the General Assembly of work dono
by them, in accordance with the provi?
sions of this Act, on or before the first
day of December in each year.
SEC. 8. That every pharmaceutist or
other person selling any poison shall bo
satisfied that the purchase is mado for
legitimate purposes, and shall keep a
book in which shall be recorded every
sale of the following articles, viz: Arse?
nic and its preparations, all metallic,
oyanides and cyanides of potassium, tar?
tar emetic, corrosive sublimate, ac?nito
and its preparations, strychnine, and all
other poison or alkaloids and thoir Balts;
can thar ides, ergot, hyn ney anio acid ; tho
said record also to exhibit tho name of
tho person to whom sold, place of his
residence and purposo of purchase, as
stated, which book shall bo kept at all
times subject to inspection by tho Coro?
ner of the County and Solicitor of tho
Circuit, and such other persons as cither
of thom may dosiguate.
SEC. 9. That all parsons in this Stato
engaged in business as pharmaceutists,
apothecaries or druggists, in either thc
wholesale or retuil of drugs, shall, to I
every bottle, vial, box, or other package
containing any poison named in the pre?
ceding section, or anyone or more of tba
following articles, viz: Oxalio acid,
chloroform, belladonna and its prepara?
tions, opium and all its preparations, ex?
cept paregorio, digitalis and ?B prepara?
tions, henbane and its preparation?,
hemlock or conium, or any other article
that may be added to this list by said
Faculty of the University, securely at?
tach a lobel, whereon shall be either
printed or legibly written with red ink,
the name of tho poison and tho name of
at least one antidoto, with brief direc?
tions as to tho mode of using the samo:
Provided, That nothing herein contained
shall be construed to apply to the filling
of prescriptions made by regular physi?
cians: And provided, further. That it
shall be the duty of tho examining body,
on application at the time of registra
turo, to furnish to the party registering
a form of labels for poisons.
SEC. 10. That this Act shall not bo
construed to prevent merchants and
shop-keepers from vending or exposing
to salo medicines already prepared: Pro?
vided, Such morohantsand shop-keepers
shall attach to the articles sold a copy of
tho label attached thereto by wholesale
druggists, and ia the sale of poisons
shall comply with tho provisions of Sec?
tions 8 and 9 of this Act.
SEO. ll. That it shall not he lawful
for the proprietor of any pharmaceutical
shop to allow any person not qualified,
in accordance with the provisions of this
Act, to dispose of poisons or compound
the prescriptions of physicians, and any
person who, upon indictment for a viola?
tion of this seotion, shall be convicted of
the same, shall pay a fine not exceeding
five hundred dollars, or suffer imprison?
ment for the period of not more than six
months.

usnal rate of wharfage on tho same, at
Martin's Point, Wudmalaw Island,
South Carolina, and to extend thc same
as far toward the channel of tho river as
may be necossary for commercial pur?
poses.
SEC. 2. That the franchise herein
granted shall be vested in the said W.
C. Garity, F. W. Towles and D. H.
Towles, their heirs, executors, adminis?
trators and assigns, for the term ol

gift, assignment or otherwise, to take

accruing from the investment.
SEO. 5. That this Act shall bo taken
and deemed a publia Act, and that the
