SECTION 1. Be it ordained, by the Mayor and the Aldermen of the city of Co? lumbia, in Council assembled, That a Board of Health be, and the same is hereby, established, whioh shell consist of twelve members, to be chosen by bal? lot by the Oity Council/at their first meeting io May of eaob and every year; and Baid Board shall be so ohosen, that three of them shall be elected from Ward No. 1, three from Ward No. 2, three f?om Ward No. 8, and three from Ward No. 4, seven of whom shall o?hstitute a quorum; and if any poreon BO elected a member of tho Board of Health, shall refuse or neglect to perform tho duties hereafter reqaired, be shall, upon con? viction, thereof before the Oity Council, forfeit and pay the Bum of forty-five dol? lars: Provided, That no person shall be compelled to serve more than one year in every three years. Ssc. 2. Be it further ordained, That the said Board of Health, of whom seven Bhalboopatitnto a quorum, shall meet at least ?b?o'h fortnight from the first day June to the first day of November of each and every year, and at suoh other times and at suoh places as they may deem necessary and ?convenient, for the purpose of receiving and communicat? ing all possible information relative to the health of the oity, and to advise and consult together respecting the preserva? tion of the aama; and shall have full and ample powers to adopt and carry into effect all such measures, rules and regu? lations as they may deem necessar]e?o the discharge of the trust hereby confided to them; and eaoh and every practical physician within the oity is hereby re? quired to give immediate information of the existence of any contagious or malig? nant disease to the Board, or to any mem? ber thereof, and at all convenient times to aid and advise tho said Board in the pt????Vatiun of tue health of tho city, and in the preservation or suppression of contagious or malignant diseases. That it shall - be the duty of each and every member of the said Board to cause to be removed, from the streets within the Ward under his or their ohargo, all of feuBivo substances or nuisances tending to endanger the health of the citizens of the city; and the Chief of Police and bis as9istauts, and the Superintendent of the Streets, are hereby required, without de? lay, to obey all ordere or precepts that shall be given them, or eittier of theos, by either of the members of tho said Board respecting the removal of such nuisances. SEO.* 4. Be il further ordained, That the ?aid Board of Health, or any mem? ber thereof, shall have power, and are hereby invested with full authority, to .enter into and upon any lot, ground or possessions of any person or persons, and thoroughly examine the same; and whenever the said Board, or any mem? ber thereof, Bball have cause to suspsct that any foul or noxious effluvia origi? nates, or is collected in any house, cel? lar, or in any enclosure whatever, shut np from public view, they, or aoy of them, may demand entry therein, and direot the same to be opened and venti? lated, or the cause of suoh effluvia to bc removed, as maybe deemed necessary; and if tho owner or oconpunt of such lot, honse, cellar or enclosure shall refuse j or delay to open the same, or Buffer it to be examined and ventilated, or removed, as aforesaid, or shall in any wise ob? struct the said Board, or any member thereof, or any polioeman or other officer, in discharge of bis or their official duty, suoh owner or occupant Khali bo fined not esocsding twenty dollars for each and every day he, ehe or they shall so neglect, refuse or dolay, after demand by said Board, or any member thereof; and chall also defray all expenses incurred in the removal or suppression of suoh nui? sances, under the direction of said Board, or any member thereof. SEO. 5. Be it further ordained, That it shall be the duty of tho City Clerk to not as clerk of the said Board of Health. SEO. 0. Be it further ordained, That it shall bo the duty of the Chief of Police, or acting Chief of Polioe, to make dili? gent inquiry as to all nuisances which may exist within tho oity; to receive all complaints which may be made to him concerning the samo, and to report im? mediately to any member or members of the Board of Health having charge of the Ward in wbioh auch nuisance exr ista; and it ?hall be the duty of the said Chief of Police, or acting Chief of Po lice, to attend the meetings of the Board of Health when required, and obey ?uah instructions as said Board of Health may give relative to the health of the city SEO. 7. Be ii further ordained. That the Chief of Police, or.actiDg Chief of Police, shall have power, and is hereby authorized and required, to demand entrance into any lot, building, cellar or enclosure, wherein be may suspect any nuisance to exist, for the purpose of ascertaining whether any such nuisance does exist therein; and if the owner or occupant of any such lot, building, cellar or enclosure shall refuse to permit said Chief of Police, or acting Chief of Polioe, so to enter for the purpose afore? said, or shall otherwise obstruct or hinder him in the discharge of the above daty, scon owner or oojupant shall forfeit aad pay for each and every offenoe a sum not exceeding twenty dollars. SEO. 8. Be il further ordained. That tho - second section of an ord mau co, passed on the 16th day of April, A. D. 1851, entitled "An ordinance to esta? blish a Board of Health," be so amended as to require that every physician in the oity of Columbia shall report to the said Board of Health, within twenty-four honre, the ooourrenoe of any ease of contagious or malignant disease in his practice, ander a penalty of ten dollars for each and every case which he shall ceglbct, within twenty-four hours after bis knowledge thereof, to report; said fine to be collected by information be? fore the Mayor, or any one of the Alder? men. SEO. 9. Be it further ordained, That this ordinance shall take effect from and after its ratification, and that all ordi? nances heretofore of force repugnant to this ordinance be, and the same are hereby, repealed.
