A During my first term in con
gress my seat was being contested I t
was almost contiuouwly engaged in 1
the preparations of the defense of mv I
contest and that consuming so much
I
of my time I had very little time to
devote to other business I had heard
before I went to congress that Mr
Wailes had a contract with the gov
ernor of the state of Florida for the
collection of Floridas Indian War
Claim and I reclgnlzed him as such
on several occasions I visited with
him the heads of several departments
aiding as far as I was able in the
work before them bearing upon this
claim During my second term In
congress not having any contest I
was then at liberty to give my un
divided time to Floridas Interests
and I was placed on u committee ofj
rlalms to which was referred a bill
for thn payment of this Florida War I
Claim and was referred to a sub
committee of which I was a member i
for examination and report It was
then that I discovered that the aid I
and assistance of the agent Mr i
Wuiles was absolutely Indlsnensa
hie to me In making a thourough and
Intelligent report of this claim to the
committee for in being a member of I
the committee I had learned the great I
Importance of a unanimous report by
that committee to the House Taking I
Mr Doughertys report as n basis for
m report I told Mr Wailes I would
expect of him the same assistance he
had given to Mr Doueherty as It was
only through Mr Wailes familiarity
with every branch of the case the al I
lowances of the two departments In
the accounting as stated by them
could be analyzed and understood by
myself Then Mr Wailes said to me
My contract has been fulfilled as I
understand It when the account had
been stated and reported upon by the
secretary of the treasurer to congress
but you know general my compensa
tlon Is contingent and thou h I have
given so many years to this work I
realize that my compensation will not
come to me until congress has made
the appropriation therefore I am at
your services at all times to aid you
In any way in my oower In securing
favorable action bv tho committee
and afterwards an appropriation bv
congress covering the account which
has already been stated Then I set
about making this roport from the
subcommittee of which I was a
member to the full committee and lnl
the work of this preparation I was II
aided zealously and energetically by
Mr Wailes In fact I could not have
done this work so thoroughly without
the aid of Mr Wailes When I had
succeeded in getting a unanimous re
port from the committee of the house
I reported the same with the bill to
the house for the calendar The sen
ate having previously reported the
same bill which occupied a good po
sition on the calendar of the house
I then asked and obtained leave to
substitute the senate bill for the I
house bill on the calendar It being
in the closing seslon of my second
term I had great doubts of its being
reached for action by the house and
so expressed myself to Mr Wailes
who suggested that he thought we
should try and secure from the com I
mittee on rules a day for Its discus
sion I answered that I thought that
would be a good thing but I am
physically unable to do such work as
the canvass of this house Involves
but shall be glad to avail myself of
your suggestion providing you will
make the canvass yourself as you are
KO well acquainted with so many of
the members That was done and a
petition signed by twothirds of the
house to the committee on rules was
secured and that committee set the
17th day of December for its consid
eration In this connection I want to
say that all along 1 had the Impres
sion and belief from what I had heard
that the sneaker being anxious to
make as e onomlcal a congress as
possible In contrast with his prede
cessor Reeds billion dollar congress
was unwilling that so large an
amount of money should be taken out
of the treasury at that time In fact
Mr Crisp told me on one occasion
that it was a very large amount of
money to pay out of the treasury in
its depleted condition I then lad a
discussion with Mr Crisp as to the
justice of Floridas claim and Its pay
ment could not be rightfully deferred
by so rich a government under any
such consideration of economy The
day set by the committee on rules
coming on at least two hours was
spent by the house in this discussion
with Mr Mallory and Senator Pasco
present Who aided m i In the discus
sion It being Satuda a difficult
day to have a quorum A quorum was
called which carried the bill to anoth
er day I feel satisfied could a vote
have been taken at that time fully
threefourths o those present would
have voted to make the senate bill a
law It will be seen that 1 have not
mentioned among the others the pres
ence of Senator Call and knowing his
attitude upon this question I had not
sought his presence and I had not
done so because he had told me that
our efforts to collect this claim would I
be all In vain and the time consumed
in the same thrown awav But
Wailes and his friends said he will
have to answer for refusing to accept
92000 for which the bill passed the
senate and was defeated by wiles and
his friends In the house and the state
would have had that much money
said he and now then will never get
a dollar In the course of this Inter
view with Senator Call in the senate
I discovered that he knew very little
about the Indian war that gave rise
to this claim as was demonstrated
when I was telling him of some of the
efforts and services of Col Samuel St
George Rogers with his regiment In
that war He said to me I was mis
taken that Col Rogers never had a
regiment In that war Knowing he
and Rogers to have been old intimate
friends and I said to him Call I am
astonished at you for I served person
ally in that war alongside of Col
Rogers on several occasions and with i
various companies of his regiment
and I am astounded that you seem to
I know nothmc about It Hearing

ed no inclination to give it if I had

this bill through In such shape as to

Mr Wailes
A I am prepared to speak em
phatically on that subject I never
knew a man so persistent so earnest
so engrossed and so familiar with the
dispatch of all duties in all depart
ments
Q How was that manifested
A You will see that the data con
tained In that report could only have
been obtained by much resource and
examination which I was unable to
g e it therefore obtained it from Mr
Wailes On many occasions Mr1
Wailes came to my room to assist me
with data for the speech I made in
the house of representathes copy of
which I leave with you I never
could have prepared that speech
without Col Wailes assistance in se
curing the facts though I knew some
of them better than he did for I was
In the Indian war as an officer at the
time these troops were serving and
had been paid and for which the
state of Florida was before congress
demanding pa ment
The witness produced a pamphlet
which is filed in evidence and mark
ed Bullock No1 In that speech
after my demand for Interest to be
paid the state in making the settle
ment there were many questions ask
ed me as to what had been done by
congress In the settlement of other
states claims and I was able to re
cite what had been done for other
states the facts for the same having I
been supplied by Col Wailes in a
brief which had been used by him
before the committee on military af
fairs
