The aboye named defendent will take notice
that the plaintiff aboTe named filed his petition
herein on the first day of August A. D. 1862, the
object and prayer of which is lo recover a judg
ment against said Whitehead lor three hund
red and ifty dollars and interest from July firpt
A. D. 1860 at the rate of ten percent per an
num due from said defendent Whitehead on two
promissory notes dated April 25th 18'50, for
t ree hundred and fifty dollars with interest
from and after the first day of July 1860 at, the
rate of ten per cent per annum, one note due
and payable on or before the first day of July
1&61 to the order of James White and assigned
to said plaintiff, calling for $150.00, and one note
due and payable on or before the first day af Ju
ly 1862, to the order of James White and assign
ed to said, plaintiff, callinr for $200.00 and for a
decree of foreclosure audsale of the South west
