Amonj; them was Sheriff Smith of Woodton county, Sheriff lltaluen, of Allen county, and two con-tables from Humboldt, besides revertl citizens from the vicinity of I'ufiilo and Humboldt. But Yesterday, the -Oih, a warrant was issued and placed in the hands of the sheriO of Allen county, rharging Luce with stealing a couple of horse a short tinn since. This morning the sheriff, with perhajss a half doz-n men, started after Luce, who wis leaving the country. As mentioned b-fore, they took dinner at'Fredoaia They then started afier the party who went through town with the the drove of stock, expecting to find Luce with them. Th po? was joined here by McOntosh, sheriff of Wilsou county, and several citizens, so there were ten or twelve men after the thief. About half past one o'clock Luce came into town in a spring wagon and slopped fur denner. A boy who hail learned what was up recognized Luce, and mounting a hor-e followed after the sheriff's party and told them that Lu- would be along pretty soon The boy over took the posse on'Ha-nbiw Creek, some fonr miles southwest of Fredonia. The party then dtvidetl, one divi-ion, consistirg of four, among whom were the sheriffs of Al len and Woodson, ambushing on the road where Luce was most likely to pass, l'rts ently he came driving along, and Sheriff Hodgen, presenting a shot gun, commacded Luce to nALT AXD SURRESPER. Instead of doing so he drew a revolver and fired, when the sheriff returned tbe com pliuient. After firing the first shot Luce jumped from the wagon, and fired four more times, but at the same time the whole party opened upon him, firing nineteen times from shot guns loaded with buck-hot One of Luce's balls struck a man named Kelso in the leg, another took the tip oil of one man's ear, and one weut through the coat skirt of one of the prty.
