Will Case.
Quite an Interesting and in many re
spects import int case of arbitration, h is
i ecu recently finished It: Milton. The
facts are these: Miss Polly Toinbeivon
o. that place, who was fitly yoniM of age
ami worth about $:15,000, in February,
1S07, bestowed her ba:;d, though l other
"goods," upon Mr. jjonatliaiij Cary.
'two years previous, to ibis event she
hud made her will, giving the bulk of
her property to the American Mission
society of New York, ami the Congre
gational Soci Hv of Milton. In August,
LViS, she died, leaving her will un
changed, and the question, as to the
validity of this will, is now Mending in
the Chittenden County Court. .
The (jucst.'ou at Ksiio in the arbitra-1
lion was as to ;hc right of the husband
to share in this sOOO, which consisted
of a farm of over :(.) acres, between ten
ami oiovcn thousand dollars in bank
dock, and seven or eight thousand dol
lars in notes secure.! by mortgage, to
gether with oilier personal property.
Tne parties opposed to Mr. Cary are
t.ie legatees of the Will, the icxccutor of
l which Dr. Onion of Milton is roprc- ,
! sen ted by C. V. Witters, Esq., of Mil-1
ton; and the lKirs-at iasv, represented
by the linn of Snith & lircrwn.of Milton,
and Park D.ivis. Esq., of the linn of
Adams & Davis, of St. Albans. Mcssre.
11. Jialltmi, of Hurnngton, ami A, U.
Ballard, Esq., of Winoo.ski, tiro eounel
for Mr. Cary. Hon, Charles Itussell,
of Turlington, and A. J. Sampson, lsq.,
of St. Albans, are the arbitra.ors. Tno
recent examination of .vitnesses, of
whom there were moie than forty, oc
cupied ciyhtccn days, Mr. Cary being
tvcptou tue witnes.1 stand nin . daysiu
.succession.
Tne decision of the arbitral, irs which
!s final, only as respects M;, dry's
right in the property, but has no bear
ing on the validity of the will, was an
n.iuncedon Tuesday. Under this de
cision the husbanil receives S0,(l()J, and
tlio Lalance of the property gojs to tao
estate.
The facts in the case, .u develope 1 by
the testimony, disclose what lawyers
would term a sonuwMat " mixed" con
ditio.i ofall'.irs, yet wo understand that
all the parties concern jd express jier
icet satisfaction in the corcjcness and
legality of th.- (L-cision. Free Picss.
