Town Council met this day in reg ular session. Present : W. B. Simp son, Mayor; Dr. Braxton Wise, J. II. Beleber, J. L\ Creswell and W. M. Abney, Councilman. W. M. Abney was called to act as Secretary. A petition of the property holders was presented, petitioning that tbe Conncil order an electiou for a new Charter. The Council resolved itself into a Committee of the Whole, to examine said petition. Upon careful examination, the Council found said petition signed by a majority of the property own ers within tbe corporate limits of tbe town, as follows, namely : To the Hon. Mayor and Council ot tbe Town of Benton, Bossier par ish, La.: The petition of the under signed citizens and property owners of tbe town of Benton, constituting a majority of the same, with respect represent that they desire a New Charter for tbe government of said town instead of the one now in exis tence, and herewith present tbe same, which has been approved by a mass meeting of said citizens. They respectfully petition your Honorable body to submit said Char ter to tbe duly qualified electors of said town, for adoption or rejection, in accordance with the provisions of Act No. 135, of the Legislature of tbe State of Louisiana, of year 1896. Thereupon, the Mayor was order ed to issue his proclamation for an election to be held on January 19th, 1897, as follows : An Ordinance Providing for the Submission to tbe duly Qualified Electors tbe question of the Adop tion or Rejection of a New Town Charter, and Providing for Elec tion of Officers Thereunder. Whereas, a petitiou signed by a majority of the property owners re siding within the corporate limits of the town of Bentou bas beeu pres ented to this Council praying that tbe question of the adoption or re jection of tbe New Charter attached to said petition, be submitted to the duly qualified electors of tbe town of Benton, under the provisions of Act No. 135, of the General Assembly of the State of Louisiana, approved July 9th, 1896, Therefore, Be it ordained by the Town Conn cil of the town of Benton, That an election be held ou Tuesday, tbe 19th day of January, 1897, at which the question of the adoption or rejection of tbe New Charter presented by petitioners shall be submitted to the duly qualified electors of the town of Benton. SEC. 2. Said election shall be held under tbe general election laws of the State of Louisiana, and the pro visions of Act No. 135, General As sembly of the State of Louisiana, of year 1896, and all duly qualified electors of said town of Benton shall be entitled to vo e at said election All electors in favor of the adoption of said New Charter shall have printed on their ballots, "For adop tion of the New Charter," and all opposed to same shall have printed on their ballots, "Agaiust adoption of the New Charter." Sec. 3. That on same day and at same time, there shall be held an election for one Mayor and five Couu oilmen, provided for in said New Charter; aad if a majority of the votes cast be in favor of tbe adop tion of said New Charter, then the person receiving a plurality of tbe votes cast for Mayor, and those re ceiving a plurality of votes cast for Councilman, shall be and compose the Mayor and Town Council for tbe town of Benton for the ensuing term as provided in said New Charter. Sec. 4. Doe notice and proclama tion of this election shall be given and made by the Mayor of this Conn cil, in accordance with the provisions of Section 2, of said Act No. 135, of the General Assembly of 1896. Ouly duly qualified voters under tbe laws of tbe State residing withiu tbe corporate limits of said Town for tbe last six months uext proceeding the day herein fixed for said election, shall lie entitled to vote. Tbe polls shall be open at 6 dock a m., and close at 6 o'clock p. m., on said day of election. Tbe following named persons are hereby ap pointed Commissioners and tbe Clerk to bold said election, who will make due returns, ac cording to law, viz: J. M. Belcher, Joe Ben jaiuiu, Ed. Logan, commissioners, and M. L. Bishop, Clerk. Given under my band, officially, this Decem ber 9th, 1896. W. B. SIMPSON, Mayor. CHARTER OF THE TOWN OF BENTON. T he inhabitants of the Town of Benton, in the Parish of Bossier, State ot Louisiana, are hereby created and made a body corporate and politic in law, with perpetual succession, to iiave and to be known by the name and style of the "Town of Benton," anil by that name they and their successors shall be capa ble of suing and being sued in all Courts of competent jurisdiction, shall or may have au official seal, aud may alter same at pleasure, shall have the right of acquiring, receiving, holding, farming, leasing or conveying proper ty, whether real or personal, within aud with out the limits of the Town, for the use and benefit of said Corporation, and shall have the power to raise money bv taxation on the prop erty situated in the limits of said Corporation, d by Licenses on traites, professions and cor porations pursued aud carried on within said iiuits. said money so raised to be applied to the use, benefit and good government of said Town or corjioratiou of the "Towu of Beuton," and to provide for aud maintain a competent tolice force for the same; and, generally, shall lave and possess all inherent rights and pow ers pertaiuing and belonging to municipal cor porations not in violation ol, or inconsistent with, the Constitution aud laws of Louisiana. Section 2. The limits and boundaries of said Corporation, or Town of Beuton, shall be aud are hereby fixed and established as follows, to wit: All that territory lying and embraced within the east half of sectiou thirty (30) and the west half of section tweuty-nine (99), in township twenty (90) North, of range thirteen (13) West, Northwestern Land District of Louisiana. Sdction 3. The officers of said Corporation shall consist of a Mayor and five Councilmeu. who shall be elected by the qualified voters of said Town, and shall hold their offices for a period of two years, and one Secretary, who shall be ex-officio Assessor, one Treasurer, one Marshal, who shall be ex-officio Collector, aud such Police officers, not to exceed two in num ber. unless in cases of emergency, as the Muyor and Council shall deem necessary; said officers, namely: Secretary, Treasurer and Marshal, shall be elected bi-annnally by the Council, and any ono ot them may be removed for sufficient cause by a majority of the Council. Section 4. 'Hie first election for Mayor and Councilmeu shall be held on the same day that this Charter is submitted for adoption, or re jection, and to be conducted by the same com missioners appointed for holding the Charter election; and in case the Charter is adopted, the Mayor aud Councilmen elected shall hold office uutil the next regular election, which shall be on the third Tuesday in November, 1898, and bi-aunually, (on the same day) there after. Sec. 5. The Mayor and Conncilmen of said Corporation, before entering upon the dis charge of theirduties, shall take aud subscribe the oath of office required ot all officers uuder the Constitution aud laws of the State, aud file same in manner prescribed by law. Sec. 6. That tbe Mayor of said Town shall be ex-officio Justice of the Peace, and as such be and is hereby vested with ail the power necessary to carry out the provisions of this act of incorporation, and to execute and en force the laws, ordinances, and regulations of the same, and shall hold his municipal Courts at such times as he may think proper. He shall preside at all meetings of the Council, and shall call special meetings thereof at such times as he may deem necessary. He shall execute or cause to be enforced all laws, regulations and ordinances legally passed by the Council. He shall hold the right to vote on questions and matters before the Council only when there is a tie vote in that body. He shall sign officially all laws and ordinances passed by the Council, and the same shall be attested by the Secretary. In the absence of the Mayor, tern porarily, the oldest member of the Council shall preside and perform the duties of Mayor; aud in case of his death or resignation, or his refusal to set, tho Board of Councilmen, by a majority vote of a quorum present, shall choose a Mayor, who shall continue in office nntil, at the next election for officers of said Town, his successor shall have been elected and inducted into office Sec. 7. The Mayor shall have full and ex elusive power to try and determine all viola tions and offenses against the laws, rules, ordi nances and bj -laws of said Corporation, and, on conviction of any person or persons, shall have power to impose aud inflict punishments as hereinafter provided. He shall have power, and it is hereby made his duty, to quell and suppress all riots, routs, unlawful assemblies, affrays and tumults, or cause the same to be done through the proper police officers, and shall have power to cause to be arrested and brought before him for trial, all offenders against the laws, ordinances and by-laws of said Corporation. All persons accused and brought to trial in pursuance of tbe provisions of this act of incorporation, or by virtue ot any law, regulation or ordinance of tbis Corpora tion shall be entitled to compulsory process allowed by State laws, to compel the attend ance of witnesses in their defense. The Cor poration shall also have power to compel the attedance of witnesses against all defendants: and, in either case, the Mayor shall issue and enforce the necessary process. Sec. 8. Whenever any person shall be tried and committed for any offense against the laws, rules, by-laws, ordinances or regulations of said corporation, the Mayor shall sentence said person to pay a fine not to exceed the sum of one hundred dollars and costs of trial, and in default of payment of said fine and costs, the person so convicted shall be impris oned in the jail of tho Parish of Bossier, or in the jail of said Corporation, for a period not to exceed one hundred days, or be compelled to work out said fine on the streets or public works of said Town, at the rate of one dollar per day. Sec. 9. The Mayor shall cause the laws, by laws and ordinances of said corporation to be published in some newspaper in said Town, if there be one, or shall promulgate the same by posting written copies thereon on the door of the Hall in which the Council holds its meet ings^ the Council may elect. He shall receive such salary as the Council may fix, not to ex ceed fifty dollars per year. Sec. 10. Tbe Councilmen of th<s Corpora tion, as a Board, a majority of whom shall constitute a quorum for the transaction of bus iness, shall hold a regular meeting at least once every month on a day to be fixed by them. Their sessions shall be public, and their pro ceedings recorded: and they shall possess the âÂ^Sÿï^.î all property taxable under the laws of the "*------ - - ----- - " ' '" s "~ "=**■«" State. owne"d, situated and being within the limits of said Town, which tax shall not be im posed and collected more than once in each year, which shall never exceed ten mills on tbe assessed valuation of said property; to levy and collect a License tax upon all trades, pro fessions, stores,shops, hotels, public boarding houses, markets, coffee houses, billiard tables, all places lor the retail of spirituous liquors, wines, beer, or other beverages, and all other Ê laces and occupations upon which a State license is levied; to prohibit houses of ill-fame aud disorderly houses, aud provide adequate punishment for same, to establish aud regulate eemetaries; to pass all needful laws aud regu lations relative to streets, buildings, crossings, bridges, alleys, side-walks, bauquetts, roads, markets, slaughter-houses, nuisiances, grog shops, and drinking houses of every descrip tion; aim to puss all needful laws and regula tions relative to the improvement, police and good government of the town; to pass laws necessary to suppress aud inflict puuishment for riots, routs, uulawful aud disorderly assem blies: also, to punish disorderly persons or those disturbing tho peace; to provide aud adopt the penalties necessary to enforce the powers conferred by this section and necessary to enforce the laws, regulations and ordinances passed enacted pursuant to the provisions of this act of incorporation; provided, that in no ease shall such penalties be other than fines or imprisonment in the parish or municipal jail, or labor upon the streets, alleys and public build ings of tbe Town; and provided further, that said fine shall in no case exceed one hundred dollars, nor shall said imprisonment or term ot labor be for a longer period than one hun dred days. Sec 11. The Council shall, at its regular meeting in the month of January of each year levy such municipal tax and prescribe such License tax as it may deem necessary and proper for that particular year. Ths Licenses so levied shall he and exigible at once, and the Taxes shall become due aud exigible ou the first day of March of each year; all Licenses shall expire on the thirty-first day of December ol each year. Half Licenses shall l>e issued after the first day of July. The rate ot taxation shall not exceed ten mills on the dollar of tbe assessed valuation of property, nor shall the Lieeuse tax exceed that levied by tbe Parish of Bossier. Sec 12. All taxes, License and dnes levied by the Town Couueil on the property of any lerson or corporation are hereby declared to je a lien and privilege upon said property, to date from the day the same are exigible, any sale thereof or incumbrance to the contrary notwithstanding, and said lien and privilege shall exist in favor of said Town of Benton for the respective amounts of taxes assessed until the same shall be paid, aud the same shall lie raid by preference to all mortgages and incuui jrances other than taxes due the State and Parish. It shall be the duty ot the Mayor to cause the Collector to make out a list of the deliuqueut tax payers, which shall merely give the names of the tax payers and the amouuts due by each respectively, not sooner tliau the first day ot April of each year, which list, after beiug signed by the Collector, shall be register ed in the mortgage records of the Parish of Bossier to preserve the lien aud privilige of the Town. Sec. 13. Tbe Collector shall have the same power and means to enforce tho payment of taxes and Licenses as are giveu by State laws to State and Parish Collectors to enforce col lection of State and Parish taxes aud Licenses. Sec. 14. The members of the Conncil shall receive for their services a compensation to be |>aid by the Council, not to exceed one dollar Tor each meeting they attend; provided, that no member shall receive pay for more than fifteen meetings in any one year. Sec. 15. The Council shall proscribe the duties and powers of the Secretary, Assessor, Collector, Treasurer, Marshal and Police officers; fix and approve the bonds of the Col lector and Treasurer; fix the compensation to be paid them; direct the manner of filling va cancies in said offices-, shall provide adequate penalties for tbe non-payment of Licenses and taxes; and make all laws necessary to sustain the Corporate government of the Town of Benton, not inconsistent with the Constitution and laws of this act of incorporation. Sec. 16. All right, title and interest of the Town ot Benton to all lauds, streets, alleys, drains, buildings and other property of what ever description and wheresover situated, with all goods, chattels, moneys, effects, debts, dues, demands, bouds, obligations, judgments, lieus, actions and rights of action, books, ac counts and vouchers are, and the same are hereby vested iu the Town of Benton, as in corporated in this act; and all valid indebted ness or liabilities of the Town of Benton shall be assumed aud paid by the Towu as constited aud incorporated by this act, and said Town is hereby declared liable therefor; and upon the adoption of this act of incorporation in the manner prescribed by law, anil the organiza tion of the Council as provided for in this act, all tbe powers, rights, privileges and immuni ties possessed and enjoyed by the Mayor and Councilmen of the Towu of Benton, as at pres ent constituted, shall cease and terminate, aud be vested in the Town of Benton as establish ed by tbis Charter aud act of incorporation. Section 17. Upon the organizatiog of the Council, as created by this act, it shall be tbe duty of the Mayor aud Councilmen, and all other officers of tho Town of Benton, to forth with turn over and deliver to tbe Mayor and Councilmen, as created by this act, all books, papers, records, documents, moneys, obliga tions, and every description of property what soever belonging to tne Town of Benton, as constituted previous to the adoption of this Charter. Sec. 18. Tho Mayor, Councilman and all other officers provided for in this Charter shall be qualified electors of the State, and shall reside within the limits of the Corporation. I n obedience to an Act of tbe Police Jury ot Bossier Parish, at a special session held at it« rooms in the town ot Benton, on the 23d day of November, 1896, based on a proper petition, I hereby give notice and proclaim that an election willbe held at Benton, the legal voting place in Ward 2, Bossier Parish, on the 28th day of December, 1896, for the purpose of giving the legal voters of said Ward 2 an opportunity to vote for or aguinsi gale of iutoxieating liquors iu said Ward.
