Cont ralts have been let for piles one lun:ried and lifty feet long, but these would no longer Ie, sufficient, and the contt:act was canceled. There is no tell ing tihe extent to which this scouring will gg, and a ferry will have to carry tie irains until somulething definite can be settled upon. Tlhe breaking through of the Mississippi and thelchange of its course is now more tIhan ever probable, and the River Commission have a hard I problem beftore them. While the Express is correct in its stat ement regarding thereniarkable deep eningof theAtcliafalaya-through which swalers of the Red and Mississippi have been poiitring in a volunme that has con staitly increased fron year to year-it is misin formed withlradirence to the ibridge matt hr. nV are able to state, upon un questionable authority, that, so far from having abandoned the project of bridg ing the stream, the railroad company has contracted for the erection of a first-class iron bridge at ihe point selected, and confidently expects to have it completed, I ready for operation, within six months from thiis date. In the case of the State of Louisiana e.c rel. Attorney General et al. vs. Juno. A. Cheevers, Judge of this Judicial District, it will beronmembered that Judge Michael lahn .rocently rendered a decision sus tamling defendant's exception that the District Court is without jurisdiction ratione mlaterioe to try the cause, and that an appeal was taken to the Supreme Court on this point. Defendant subsetilently appeared be fore the latter tribunal and moved to dismiss the appeal, oil the ground that the transcript was not filed within the delay prescribed and required by law. On Monday last the Supreme Court dis posed of this motion by the following decision, rendered by Justice Todd with the concurrence of all the other Judges: The motion to dismiss the appeal is on the ground .that the transcript was not filed in time. The sulit involves themigid, tbe an office anti is brought l nder thi intrusion act. The law in such cases requires that an appeal "shall be returnable in ten days after judgment of the lower court." Sec tion 7, act 45, extra session of 1870. The judgment appealed from was signed on the 29th March, 1881, and the appeal was granted the same dlay, and made re turnable to this court in tenll days. The transcript was filed here on the 9th of April. Even conceding that the ten days delay expired on the 8th of April, as contended for by the appellee's counsel, still there is nothing in this case that takes it out of the operation of the rule fixed and establisihed by the jurispre dence of the State, that a transcrilpt of appeal may be filed within the three judicial days following the first return day. 32 A., 801. The transcript was therefore filed in time. Motion to dismiss refused. The exception appealed from is no0w before the court on its merits, and a de cision will doubtless be rendered at an earlyday. The Sunday Magazine for June Is peculiarly attractive in its literary and ;artistic departments, and brilliantly closes the ninth semi-annual volume. It isal pub lication which should be found in every household, for its literature is pure au.d healthy; it is always vivacious, and edifies while it entertains and instructs. The 128 quarto pages are crowded with good things; among the most prominent articles are "A Peep at the Mormons;" " Country Churdh Architecture," by J. Dlenton; "Experiences in Australia and Ceylon," by Philip Phillips; " The Modern Sunday-school Movement," tby Calhles B. Stout; "Adoniram Jutdson," by IRt. Rev. W. Packeulnham Walsh, D. This very remarkable enterprise continues to make such progress as to astonish its friends and-.,stound its mnemies. This building, though six stories in height, 25 feet front andt 100 feet deer, is sufficient on ly for the offices and retail store of the Com paIy. The manufacturing is carried on in cevcral large builings, located in other parts of the city, though it is contemplated con centr~ating them soon in one immense fae ttnry to be erected. .Their list of recent and early forthcoming publications is extreme ly interesting to all who enjoy what is choic est in literature. Donnaud -and he has many in this vicinity-will be pleased to hear of his promotion from general reporter on the staff of the New Orleans Times to the importaift post of city editor of that influential journal. If we had only our own jndgment to base the assertion on, we might hesitate, for personal reasons, to say that the local department of the Times bha materially improved under Mr. Donnatrd's supervi sion, but we have heard so many of the readers of the paper express a similar opinion, that we have no ioom for doubt in the premises. A fluent and brilliant writer himself, Mr. Donnaud is demon strating a no less successful faculty for directing and revising the writings of others.
