HOPE FOR DANVILLE
Right to Appeal to Supreme Court In
Case Against Southern Railway.
The caso of tho city of Danville, Va.,
against the Southern Railway, Which has
been before the Interstate Commerce
Commission and the Federal courts In
one form or another for the past four
years, will now bo taken to the highest
court In the land, the Supreme Court of
the United States.
Tho caso was first heard at Danvlllo by
a portion of tlio Interstate Commission,
which upheld the city's complaint of dis?
criminating in its rates against that city
by the Southern Railway and thin find?
ing waa confirmed later by the full com?
mission, and tho railway directed to dis?
continue the discrimination complained
of. The railway Ignored tho mandate of
the commission and appealed to the
United States Circuit Court at Danville.
This tribunal sustained the defense of tho
railway, and reversed nnd annulled tho
finding of the; Interstate Commission. Not
satisfied with this, the Commission took
the case to tho United States Cireult
Court of Appeals, and at tho recent sit?
ting of that tribunal In this city the low?
er court was upheld and the commission
suffered another reverso.
Now Judge Nathan Goff, of the Circuit
Court of Appeals, has granted (he appeal
of tho Commission from Its recent de?
cision, and tho case will go to tho Su?
preme Court of the United States. Tho
case Is a very Important one as upon this
decision hinges the hopes of mnny other
towns which complain of discriminations
against them by railways, thus handicap?
ping them In manufacturing and Jobbing
and giving nn advantage to other cities
nt common or bnslng points, as they are
known In railway tariff ? parlance. Tho
city of Danville has mado a pluoky fight,
and now the Commission shows a disposi?
tion to carry their contest to the last
ditch.
