Tho jury In Judge Mcck'H court In this city has found Jmnofl White, a local grocer, guilty ot selling ndulternted coffee. The prose cution wan based on u packngu of Ar buckler Arlosa coffee. The State of Ohio, throf.k Uio Turc Food Commission, prosecuted White. The enso was on trial for nearly u month and attracted national atten tion. The manufacturers of Arlosa coffee conducted the ' defense for Grocer White. The host attorneys In the country wore retained to defend him, hut, nftor a short consultation, n ver dict of guilty was returned by the Jury. Tho State of Ohio considers this a big victory. Pure Food Commissioner Ulackburn has been waging n warfare on spurious food articles and tho de partment has been successful. Tho complaint of tho Statu of Ohio was that Arlosa coffeo was coated with a substance which couecnled defects In the coffeo nnd mnde It appear bettet than It Is. Tho Stnte charged this eontlng or glnzlnjj was a favorable me dlum for the propagation of bacteria. l'rof. G. A. Klrchmaier, of this city, n well known chemist, was the princi pal witness for tho State. Ho had made scientific examinations of snm pies of Arlosa purchased from Grocer White In the open market. He found that each Arlosa berry contained an average of .'100 bacteria. Mr. Klrch maier further testllled that other cof fees ho examined contained few bacte ria or none nt nil. He declared that tho glnzed coffeo was not a wholesome food product. Chemist Schmidt, of Cincinnati, cor roborated the testimony of l'rof. Kirch maler. The Stnte did not present fur ther testimony. Tho defense through the Arbucklcs, who prepared this glazed coffee, se cured some of the most eminent chem ists and scientists In the United States to give testimony In their behalf, l'rof. II. W. Wiley, of the United States Ag ricultural Department; l'rof. Vaughn of Ann Arbor University; I'rofs. Welle and Webber, of the Ohio Stnto Univer sity, were called to defend Arlosa. Dr. Wiley had made a careful examination of the method of Manufacturing Arlo sa. Ho told of the 10.000.000 eggs used by the Arbuckles yearly In the prepara tion of this glazing. On this point In cross examination, the State's attorney deftly drew from him the Information that these eggs might be kept in cold otornge by tho Arbuckles for a year or two at u time. The experts who heard Dr. Wiley's testimony were pleased to be able to "catch" to famous n chemist. The doc tor nt one point In his testimony ex plained very clearly how It Is that the egg put Into the coffee pot by the house wife settles the coffee. He said that tho heat coagulates the egg, and as It sinks to the bottom of the pot It carries the line particles of coffeo with It, and thus clarifies the drink. It Is the act of coagulation In the coffeo pot that does the work. Later on in his cross exam ination, iio had to admit that when the egg was put on Arlosa coffee nt the factory It became coagulated, and as egg cannot be coagulated but once, that (lie coating on coffee was practically no value, as a "settler" when it reached the coffee pot. '"' Wiley acknowledged that tho g)it.ii . might be n favorable medium for the propagation of bacteria, al though lie would not testify positively cither way because he was'not n bac teriologist. l'rof. Vaughn, of Ann Arbor, also a witness for tho Arbuckles, said he found bacteria on Arlosa coffee. l'rof. IHelle, nnother witness for tho defense, found nny number of lively bacteria on Arlosa coffeo lie examined, nnd lie agreed that glazed coffee surely was a more favorablo medium for the propagation of bactcrln than uuglazcd coffee. l'uro Food Commissioner Ulnekburn says: "Tho Stato Is very much elated over Its victory against this corpora tion. We are now considering tho ad visability of Informing every grocer In tho Stnte of Ohio that it Is an Infrac tion of tho laws to sell Arlosa, and at the same time give warning to con sumers that tho coffeo Is an adulterat ed food article." Tho verdict of the Jury in this case Is of national Importnnco because a great many other States have pure food laws like that of Ohio, and It Is natural to suppose tlint similar action will be taken by other l'uro Food Commis sioners to prevent tho sale of glazed coffees.
