per lepoits of the remarkable cures ol ca
tarrh, X am induced to tell " what I know
about catarrh," and I fancy the"snuff"
and "Inhaling tube" makers (mere dol

Sec. 3. All persons entitled hy law to
vote for Members of Assembly shall be
entitled to vote at such election iv their
respective election districts, and not
elsewhere. Such eleotoln shall bo by
ballot.
Sec. J. The following regulations shall
apply to the aforesaid election, to be held
ou the third Wednesday in June, A. D.
eighteen hundred and seventy-eight:
First—The said election shall be held
and conducted by the proper election of
ficers of the several election districts of
the State, and shall be governed and reg
ulated lv all respects by the general eh c
tlon laws of the state in toroe at tho
time of said election, so far as the same
shal Ibe applicable thereto, and not in
consistent with tiie provisions of toll
act.
Second—At the special election to he
held under this act, if no ottiei provision
for printing and using new Oreat Regis
ters or ward registers shall have In the
meantime been made by law, the copies
ofthe Great Registers which were used in
the several counties of this State at the
general election held In the year eighteen
hundred and seventy-seven shall bo
used. The Boards of Supervisors must
furnish the Boards of Election of each
precinct In their respective counties, he
lore the day on which said special elec
tion is appointed to be held, at least ono
copy of the aforesaid printed Oreat Reg
ister. If the Boards of Supervisors can
not otherwise ob*aln a •affloisnt number
of copies of the register /or the purpose!
it must take the copies filed in the office
ol the County Clerk, in pursuance of sec
tion one thousand two hundred and six*
ty-eight of tho Political Code, if tho
copy of the register which shall bo fur
nished to any precinct shall have been
used at any previous election, lhe char
acter "X" may be used instead of the
word "voted," as required by section one
thousand two hundred and twenty-eight
of the Political Code. It shall not be Oie
duty of the Boards of Election to post
copies of the Oreat Register, as required
by section one thousand one hundred
and forty-nine of the Political Code. Tlie
voter, when lie oilers his bal lot at a poll
ing place, shall not be required to an
nounce his number 0|) the Oreat Regis
ter, as provided for In section one thoui
and two hundred and twenty-five of the
Political Code.
Third—The oUlcers of the several coun
ties of this State, whoso duty it is under
tho law to receive and canvass tho re
turns from the several preolnotsof their
respective counties, its well us the city
aud county ot San Francisco, shall meet
at the usual place of meeting lor such
purpose on the second Monday after stud
election. 11, at Ihe time of meeting, the
returns from each precinct In tho count /
in which polls were opened have been re
ceived, tho Board must then and thero
proceed to canvass the returns; but if all
returns have not been received, the can
vass must be postponed Jrojn day today
until all ofthe returns arc received or until
six postponements havo been had, when
they shall proceed to make out returns ol
the votes east for delegates to be mem
bers ofthe Convention; and the proceed
ings of the officers whose duty it Is to
make out said returns shall be the same,
as those prescribed for like officers lv t he
case of au election for Oovernor, except
that the returns shall be transmitted to
tho Secretary of State. Tho persons re
ceiving the highest number of votes at
such election shall be elected, except in
the ease ot persons voted for as delegates
at large. Ofthe persons so voted for as
delegates at large, the «ight persons, resi
dents of any ono Congressional Dietrict,
who shall havo received a plurality of
votes overall other persons, severally,
who reside in the same Congressional
District, shall be declared elected such
delegates ut large.
Fourth—The Secretary nf State shall,
as soon au the returns of said election
shall bo received by him, or within
twenty days after suid election, in t he
presence of the Governor and Controller
of State, open and compute all of the re
turns received of votes given for mem
bers of the Con yen! ion, and the Governor
shall forthwith issue his proclamation,
declaring the names of the persons who
have been chosen mcmb.rs of said Con
vention.
Sec.a. Tho delegates wo chosen shall
meet in Convention In tho Assembly
Chamber at the Capitol, in the city of
Sacramento, on the twenty-eighth ol
September, eighteen hundred and soven
ty-elwjht, ut twelve o'clock M. They
shall, by a viva voce vote, and ihe vote
shall bo entered on the Journal, elect
one of thf-Ir number President, aud such
Secretaries and other officers as they
may deem ntccss-ary. Afer the said
Convention has met ami organized, it
shall have power to adjourn to and hold
Its meetings at any place In trnld city ol
Sacramento other than the said Assem
bly Chamber, and all committee rooms
of the Mtato Capitol bulldlug shall be un
der the control of said Convention.
The President of the Convention may ap
point not exceeding one Doorkeeper and
lour Pages. The Convention may select
Phonographic Reporters, and tlx the
amount of inelr compensation; also, a
Sergeanl-nt-Armx and one assistant. The
delegates to tbe Convention shull receive
the same per d'eni and mileage as mem
bars of lhe Legislature; provided, nocom

All public officers, Boards and Commis
sions shall fuinlsh such Convention with
all such information, papers, statement)*,
books or other public dooumentlJn their
possession us tne Bald Convention shall
order or require for its use from time to
time while in session, itshall be the
duty of lhe Secretary of State lo furnish
the members of said Convention with
stationery to tho amount provided by
law for the Legislature while in session,
and to the Convention such stationery,
manual,tile bo-mls ami other like things
as are lUrnlibed to the two Houses of the
Legislature. Said Convention may adopt
such rules and regulations for its own
government as a majority of its members
may determine, and said Convention
shall be the judge of the election and
qualification ol its own members.
Sec. B. AJournal of the proceedings of
the said Convention shall be kept, and
■ball, at the final adjournment thereof,
be Hied in the office of tho Secretary ot
state, and tho Constitution agreed to by
the Convention shall bo recorded in his
office. A majority of the Convention
shall constitute a quorum to do business.
The doors of the Convention shall be
kept .pen, except when tho public wel
fare shall require ■eoresy. Every dele
gate to the Convention shall have the
like privileges from errest aud from civil
process as members of the Legislature
now have by law. For nny speech or de
bate in the Convention, the delegates
■hall not be questioned In any other
place. The Convention shall have the
power to expel any of Its members, and
to punish Its members and officers for
disorderly behavior, hy imprisonment o<*
Otherwise; but no member shall bo ex
pelled until tho report of a committee
appointed to inquire Into tho facts alleg
ed as the groinm of his expulsion shall
have been made. The Convention sliall
have tho power to punish as a contempt
and by Imprisonment or otherwise, a
breach of his privileges, or of thu privil
eges of its members, but such power shall
not bo exercised exeapt against persons
guilty of oue or more of the following of
fenses:
First—The offense of arresting or sub
jecting a member or officer of tho Con
vention to civil process, in violation of
his privilege from arrest AS heretofore
declared.
Second— That of disorderly conduct In
the immediate view and presence ot the
Convention, und directly tending to In
terrupt its proceedings.
Third—That of publish ing any false and
malicious report ofthe proceedings of the
Convention, or of the conduct of a mem
ber in his delegated capacity.
Fourth—That of ret using to attend or be
examined, as a witness,either belorc ihe
Convention or a committee to take testi
mony in the proceeding of the Conven
ti jn.
Fifth—l bat Of giving or offering a bribe
to a member, or of attempting by menace
or any other corrupt means or device, di
rectly or indirectly, to control or influ
ence a member in giving his vote, or lo
prevent him from giving the same.

shail punish any of its members, or offi
cers, or any ol her person, by Imprison*
meat, such Imprisonment shull not ex
tend beyond the session of the Conven
tion. Every person appointed to the of
fice ol Secretary ofthe Convention shall,
before he enters on t he duties of his olllee,
execute a bond to the people ol the state
with such security as the Controller shall
approve. In the penal sum of five thous
and dollar*, conditioned that he shall
faithfully perform the duties of his office
and account for all moneys which- may
come into his bands by vlituethereof.
Sec. 7. The Constitution framed hy
such Conventiod shall bo submitled by
the Convention to the pco.de for their
adoption or rejection at a special election
to be held on the first Wednesday of May,
eighteen hundred and seventy-nine, arid
every person hereby entitled to vote for
delegates may vote at thßt election, on
such adoption or rejection. In the elect ion
district lv which he shall then reside,
and not elsewhere. The said Constitu
tion shall bo voted on us a whole. No
other question than ihe adoption or re
jection of the proposed Consiltutlon
shall be submitted to the people or voted
on at such election, any statute or law
totho contrary notwithstanding. The
Convention shall prescribe the publica
tion of said Constitution, and the notice
to be given of the election. The baiiotsar
tickets shall have priuted or written up*
on l hem the words " For the New-C'-nsti
tution," or "Against tho New OonstltU*
tion," and nil the provisions of law now I
or at that time existing in i egard to gen
eral elections shall be applicable to such
election, except that the provisions of the
and si c >nd subdivisions of sect ion
four of this act shall also apply lo said
election. Tho canvassing and returns of
the votes cast upon such question shall,
in such manner as the Convention shall
direct, be certified to the Executive of tho
state, who shall call lo his assistance
the Controller, Treasurer and secretary
of state, nnd co i)pare the votes as certi
fied to him. If, by such an examination,
It is ascertained that a majority of the
whole number of votes cast at such cle„
tion bo in favor of such new Constitu
tion, the Executive of tht.s state shall,
by his proclamation, declare such new
Constitution lo bo the Constitution of
the State of California, ami that It will
take effect at such time as tho said
Convent ion may havo in its direc
tion, by resolution, or in said Constitu
tion itself, fixed. If said Convention fix
no time for said Constitution to take ef
fect, then it shall take effect immediately
upon such proclamation being made.
Sec. 8. Ail willful and corrupt false
swearing In taking auy of the oaths pre
scribed by this act, or by the laws of this
State made applicable to this act, or in
any other mode or form In carrying Into
effect this act,shall be deemed perjury,
and shail be punished In Iho manner
now prescribed by law for willful and
corrupt perjury.
Sec. 9. It shall be tho duty of lhe Sec
retary of S ale to cause this act to be
published once p. month after Its passage,
until tho election of delegates herein
provided, In not more than live of the
public newspapers published in this
state—one of said publications to bo in
some newspaper published In iho city
nnd county of Francisco, and one in the
city of Sacramento, and one In the coun
ty of Los Angeles, and ono In the county
of Nevada, and ono in t he county of Tu
lare; and the expense of publishing the
same, and ull other legal expenses in
curred in printing for the Convention,
shaii be audited by tho Controller and
paid by the State Treasurer, according to
law.
Skc. 10. AU the printing necessary for
the said Convention, under the provis
ions of thll act, shall be done and per
formed at the State Printing office.
Sec. 11. In casoany vacancy occurs,by
reason of tho death, resignation, or other
wise, of any delegate elected to said Con
vention, the same shall be filled by the
Convention
Sec. 12. The snratf one hundred and
fifty thousand dollars, or so much there
of as may be necessary, Is hereby appro
priated out of any money In the state
Treasury, to pay the expenses of the Cou
vention provided for in thi* act.
