SAN;FRANCISCO
SULLIVAN IS IN FINE FORM
Paltlmore Boy Confident of Winning
Title From Native Son, and Will
Have ..Plenty of Backing,
Brltt the Favorite
By Associated Press
( BAN FRANCISCO. July 20.— A hurri
cane battle is looked for when Jimmy
'Brltt faces Kid Bullivan at Woodward's
: pavilion' tonight. Britt will defend the
.lightweight title against the aspirations
of the Baltimore boy, Bulllvan's admirers
-; have £: Increased In , number every day.
v Brltt ;ls: always known to be In the best
iof condition. In fact he generally has a
bit on hl« opponent as fur as downright
■ physics.! condition Is concerned, but to
night Jimmy cannot count on an advan
tage In this respect. - Sullivan Is certainly
, the ■ acme ■of physical perfection. • When
he started training a few weeks »ajro he
, was in Rood trim, and two weeks and a
; half of constant grind has Increased his
wonderful muscular development twofold.
(The" Baltimore boxer will weigh every
' ounce of 133 pounds when he enters the
• ring ' tonight. And It will all be Rood.
1 hard, ' sound, fighting flesh. He weighed
; 13414 pounds when he ceased active gym
iwork Tuesday. Sullivan Is confident that
/he will : be able to bring over the sleep
producing'wallop and is prepared to put
up, the .battle, of his life when he hooks
up with the native son.
I The champion realizes that Sullivan is a
tough nut to crack and Is prepared to go
any kind of a gait to add Sullivan's scalp
to his belt. Britt has everything to lose
In ■ tonight's battle. He Is practically
fighting for the stakes In the proposed
contest with Battling Nelson, for should
the Baltimore boy triumph It will take
the edge off the Nelson bout. > ■ •
"Britt ought to win." ' says Bplder
, Kelly, x who '■ will second Britt tonight.
. "Sullivan is -a tough fellow and will be
-hard to put away. Such nghters always
i have a chance, especially when they have
the punch. I think Brltt has too good a
head for Sullivan and will outgamo htm.
I Tou I know Jimmy Is quite strong In the
knowledge of boxing and that cuts quite
a figure/! • -,-.■,-
Locally, there is quite a bit of Sullivan
-money In sight at 10 lo 8, with Brltt on
: the long end. -Sullivan's supporters count
/on -better odds,' however, and are'hold
' Ing ' out. ' The - advance sale of seats is
particularly, large for this time of year,
. and Morris Levy, the manager of ■ the
■ Hayes Valley club, under which the fight
will be held. Is preparing to comfortably
I handle a big bunch of spectators. Orders
1 from - the - out-of-town element have
poured in fast, indicating that there is a
'.world of Interest throughout the state in
tonight's mill. Jack Welch will be the
' third man in the ring. . -

cur — New Trial at Once Started - '
By Associated Press.
PORTLAND, July 20.— After being
closeted together for forty-six hours
and taking forty-two ballots, *in .which
the vote was ten / for ' conviction and
two for acquittal; the Jury in the case
of Congressman Williamson,' Dr. Van
Gesner and United States Commission
er Biggs reported to, Judge De Haven
In the United States district court this
afternoon that : It., could- not agree, j and
it was discharged.' Judge • De, Haven
asked each Jurori individually if there
was any hope 'for an agreement, to
which . each responded that ? there was j
not. The court .then ordered) the clerk I
to enter an order of dismissal.
District Attorney Heney stated that
he would like to try the Williamson
case over again, whereupon Judge De
Haven set the case for tomorrow. . .
. Judge Bennett for , the . defense was
much averse to going to trial at once,
and pleaded for. time in .which to "get
ourselves together," -but Judge De.Ha
ven said the case would be set for to
morrow. The ' work of Impaneling a
Jury will then begin, and by the time
this is done the witnesses will be on
hand. - - ■ -;:".:-../
On entering the court room Judge
De Haven asked"" the Jury ' if " it
had arrived at a verdict. .Fore
man Hilke sald.lt had. not and- that
there appeared to.be no prospect that
one would be .reached. . Judge De Ha
ven asked \i the jury understood " that
they could find one defendant innocent
and the Jurors said they did.- W. \ O.
Cook then addressed the court,, saying
that the Jury had balloted several times,
with the same result, 'that each man
had taken a part in- the discussion, and
that Is was evident no verdict could be
reached, j Judge jDe Haven then dis
missed the Jury from i further . attend
ance upon the court. '
The two Jurors who stood but' against
the majority were for acquittal or com
promise. It has been ascertained that
W. O. Cook, who was 'supposed for. a
long time to have stood out alone for
acquittal, was, favorable to the 'gov
ernment. ■ - - '" $

Dy Associated Pres*
SACRAMENTO, July 20.-Justice Mc-
Laughlln of the court of appeals/who
has been a sufferer from abscess in the
ear, was slightly better yesterday and
was able to take a walk with an escort.'
It Is still a matter of doubt If a surgi
cal operation will have to be performed
on his ear. If he is unable to go on the
bench next Monday the supreme court
will name some other appellate court
Judge, probably from San Francisco,
to sit in his place.
The constitution requires three Judges
to make up the court except in the case
of chamber proceedings.
