closeted together for forty-six hours
and taking forty-two ballots, *in .which
the vote was ten / for ' conviction and
two for acquittal; the Jury in the case
of Congressman Williamson,' Dr. Van
Gesner and United States Commission
er Biggs reported to, Judge De Haven
In the United States district court this
afternoon that : It., could- not agree, j and
it was discharged.' Judge • De, Haven
asked each Jurori individually if there
was any hope 'for an agreement, to
which . each responded that ? there was j
not. The court .then ordered) the clerk I
to enter an order of dismissal.
District Attorney Heney stated that
he would like to try the Williamson
case over again, whereupon Judge De
Haven set the case for tomorrow. . .
. Judge Bennett for , the . defense was
much averse to going to trial at once,
and pleaded for. time in .which to "get
ourselves together," -but Judge De.Ha
ven said the case would be set for to
morrow. The ' work of Impaneling a
Jury will then begin, and by the time
this is done the witnesses will be on

On entering the court room Judge
De Haven asked"" the Jury ' if " it
had arrived at a verdict. .Fore
man Hilke sald.lt had. not and- that
there appeared to.be no prospect that

Cook then addressed the court,, saying
that the Jury had balloted several times,
with the same result, 'that each man
had taken a part in- the discussion, and
that Is was evident no verdict could be

The two Jurors who stood but' against
the majority were for acquittal or com
promise. It has been ascertained that
W. O. Cook, who was 'supposed for. a
long time to have stood out alone for
acquittal, was, favorable to the 'gov

It Is still a matter of doubt If a surgi
cal operation will have to be performed
on his ear. If he is unable to go on the
bench next Monday the supreme court
will name some other appellate court
Judge, probably from San Francisco,
to sit in his place.
The constitution requires three Judges
to make up the court except in the case
of chamber proceedings.
