How tho Cession of tho Islands is
to bo Accomplished.
Tho full toxt of tho treaty ia ao
Tho United States and tho Republic
of Hawaii, in view of tho
natural depondonoa of tho Hawaiian
Islands upon tho United States, of
thoir geographical proximity
of tho preponderant share acquired
by tho United Stntos and its
citizens in the industries and trade
of said islands, and of tho oxprotsed
desire of tho govornmont of tho republic
of Hawaii that thoso islands
should bo incorporated into tho
United States as an integral part
thoreof and under its sovereignty,
havo detormined to accomplish by
treaty an objsct so important to
thoir mutual and permanent welfare.
To this ond, tho high contracting
parlies havo conferred full powers
and authority upon their
Tho Prosident of tho United
States, John Sherman, Secretary of
State of tho United States; the
Prosideat of the Republio of Hawaii,
Francis March Hatch, Lorrin A.
Thurstou, and William A. Kinney.
Tho Ropublio of Hawoii hereby
codes absolutely and without reserve
to the United States of
all rights of sovereignty of
whatsoever kind in and ovor tho Hawaiian
Islands and thoir dependencies;
and it is agreed that all territory
of and appertaining to tho republic
of Hawaii is horoby annexed
to tho United States of Amorica under
tho uamo of the Territory of
The republic of Hawaii also cedes
and hereby transfers to tho United
States tho absolute foe and owner
ship of all public, govornmont, or
crown lands, public buildings or
edificog, ports, harbors, military
equipments, and all other publio
property of ovory kind and description
belonging to tho government
of the Hawaiian Islands, together
with every right and appurtenance
The existing laws of tho United
States relative to public lands shall
not apply to such lands in tho Hawaiian
islands; but tho Congress of
the United States shall enaofc special
laws for their management and disposition;
provided, that all revenue
from or proceeds of tho same, except
as regards such parts thereof as
may bo used or oooupied for tho
civil, military, or naval purposes of
tho United States, or may be assigned
for tho use of the local government,
shall be used sololy for tho
benefit of the inhabitants of tho
Hawaiian islands for educational and
other publio purposes,
Until Congress shall provide for
tho government of such islands all
tho civil, judicial and military pow-ors
oxeroisod by tho officers of the
oxisting government in said islands
shull be vested in suoh person or
persons and shall bo exorcised in
suoh manner as tho President of tho
United Stato shall direot, and tho
President shall havo power to
said officers and fill tho vacancies
so occasioned. '
Tho existing treatios of tho Hawaiian
Islands with foreign nations
shall forthwith ceaso and dotormino,
being roplaced by suoh treaties as
way oxist, or as may be horoafter
concluded botween tho United
States and suoh foroign nations.
Tbo municipal legislation of tho Hawaiian
Islands, not onactod for tho
fulfillment of tho treatios so extinguished,
and not inconsistent with
this treaty nor contrary to tho Constitution
of the United States, nor
to any oxisting troaty of the United
Stales, shall remain in for jo until
tho Congress of tho United States
shall otherwise determino.
Until legislation shall bo enaotod
extending tho United Statos customs
laws and rogulatiouB to tho Hawaiian
Island's, the oxisting customs
rolatious of tho Hnwaiiau Islands
with tho United Statos and othor
cauutrioB shall remain uuohauged.
Tho publio debt of tho Ropublio
of Hawaii, lawfully rxiating at tho
dato of tho oxohougo of the ratifications
of tho troaty, inoludiug tho
amounts duo to depositors in tho
Hawaiian Postal Savings Btnk, is
hereby assumed by tho Government
of tho Uuitod Statei; but tho liability
of the United Statos iu this regard
shall in no caso oxoeod $-1,000,-000.
So long, hnwovor, as tho existing
government and tho present ro
lations of tho Hawaiian Islands are
continued, as horoinbsforo provided,
said govornmont shall continue to
pay tho interest on said dobt.
There shall bo no further immigration
of Ohineso into tho Hawaiian
Island, except upon such
conditions as are now or may hereafter
bo allowod by tho laws of tho
United States, and no Chinoso, by
reason of anything herein contained,
shall be allowed to onter tho Uuitod
Statos from tho Hawaiian Islands.
Tho President shall appoint fivo
commissioners, at loast two of whom
shall bo residonts of the Hawaiian
Islands, who shall, as soon as reasonably
practicable, recommend to Congress
such legislation for tho Territory
of Hawaii as they shall deem
necessary or proper.
This treaty shall bo ratified by tho
President of tho Unitod States, by
and with tho advico and consent of
tho Senate, on tho ono part; and by
tho President of tho Ropublio of
Hawaii, by and with the advico and
consent of tho Senate, iu accordance
with the Constitution of said republic,
on the other; and the ratifications
hereof shall bo oxchangod at
Washington as soon as possible.
In witness whereof, tho respective
Plenipotentiaries havo signed the
abovo artiolos and havo hereunto
affixed thoir seals.
