I believe that the opportunity
offers for the formation of a bill
which will prorido for a simplo form
of government an opportunity for
a representative government to be

be our guiding star in forming the
county bill presented to tho legisla

that tho elaborate bill which wa
proBodled to tho legislature of 1003
contains many valuable suggestions
and much piUDStcin work but it
was in many respoata in conflict
with the Organic AuK and I raised
two of these points beforo the Su
premo Court I also believe there
were many vulnerable poiutB in the
aot itself I think as lawyers our
reputation are at rtako and we
should draw up a report whioh
should be free from any conflict
with tho Organio Act
1 believe alio that the County
Act of 1903 uontninsmoie than it
should have done in tho way of oom
plioations irrespective of the pro
visions of the County Act I dont
see any roauoti to havo in it the
revenue measured and license Aot
that were placed in the Act of 1903
Those mattora can bo handled by a
simplo amoudmont to tho present
law upon those two aubjeots
1 also feel n grave doubt about
the right of tho Territory to transfer
territorial property to counties I

special feeling is that we should take
no chances on this subjeot
Then comes the question of the
form of government From a poli
tical standpoint thoss who dosire to

of tho people to hare their affairs
conducted by bo peoplo of their

of the primal essentials I feel that
is doubtful legally The Boaid of
Supervisors is undoubtedly a public
Board and in the opinion of our
firm in testing the case boforo the
Supreme Court we uontouded that
the election of a Board of Suporvl
tors was coutrary to the Organio
Aot These are not soimiuea opin
ions or unsltornble oonylotions hut
the growth of thought and exper
ience in oontaot with tho Act of 1903
How shall the county bo govern

people or by a Board appointed by

I would not express an opinion
upon this one way or tho other but
it appears to mo tho matter comes
down to that point
I believe that we oau make pro
gress by taking up the Aot of 1903
going through it poselbly sevoral
times at first striking out those soo
tious whioh we feel nearly should
iot bp admitted as a part of tho new
Act then taking P ports not so
otoar and arriving at n couolusion
as to whether they should romain or
not and taking up tho bill and cor
rooting wording in tho remainder
