Berry Is Liable to Arrest

Report publishes a letter received from
Hon A B Meachatn by a friend in this I
city dated October 9tb After relating
the killing of Johnson aud the demand
of the Utes for the surrender of the pri
soners he says tbo Ute would not con
sent to allow the prhoners to be taken to
the cantonment but did agree that they
might be taken to Gunnion City pro
vided three responsible white men would
go with them and have them tried by
law and executed This agreement was
mad at 830 on Friday morning It
was the only alternative to take
Every white man knew that
while there were only twentytwo
Utes present a fight would be the
signal for a daughter of every white
man in the t Ute country There were
many hundreds of miles of road with
fre gntera in every direction exposed
and unwarned of the danger The only
thing to do was done The prisoners
were reegatEd to citizens and soldiers
The Utes also Agent Berry and myself
left for home Tbe Utes made a compact
in good faith as did the white men
After we had all started the citizens held
a talk with the prisoners and the wagon
bos and agreed that the man who
fired the fatal shot should go with
the citizens to Gunnison for trial
The Utes meantime going by trail over
the mountains met a large war party
and were overruled and turned back to
Clines and overtook the citizens taking
the prisoners forcibly andmaking threats
of death compelled the guard to leave
the road Weal become of the prisoner
is not known but there is not much
doubt I know the compromise was
oonajtae and that the release was also
bonajide and terribly in earnest As
mgbt be expected there are rumors of a
put upjob but I do not believe it

today received a telegram from General
Pope as follows I have received a tele
gram announcing the opinion of tho
United States attorney central that
Agent Berry aid his subordinates are
subject to the jurisdiction of the slate of
Colorado although on tbe Indian reser

protected from arrest I have withdrawn
the orders given by the direction of the
President and the military force will in
no respect take action in the matter of
arrest As to the arrest of the Indians
the attorney general reserves his opinion

the council general and rarved an
amendment to pas the order of the day

Five Women Burned to Death
Cincinnati 20A shocking calamity
in connection with a fire occurred sho tly
after 11 oclock this morning A fire
broke out in Shoddymans factory of
Benjamin Hey Second and Broadway
in such a way as to cut off cape from
the third story where a number of women
were at work Tne firemen made heroic
but iueflecmsl attempts to rescue the
women After extinguishing Ihe fire the
firemen succeeded in extricating the dead
bodies of five women not yet identified
The loss is estimated at 250000 in

Twenty girls and eight women were in
the third story when tbe fire broke out
The girls passed down the stairs safely
but only two of the women followed
their example It is supposed six of
them delayed to change their clothing
until the lire cut off their escape One
of them broke her legs jumping from
