AN ORDINANCE
Licensing and Regulating the Sale
of Spirituous and Fermented
Liquors
SECTION 1Be it ordained by the
City Council of Salt Lake City
That no person firm or corporation
shall within the corporate limits of
said city directly or indirectly in
person or by another sell barter or
otherwise dispose of or permit to be
bartered or delivered for or on his
account any vinous spirituous or
fermented liquors without a license
first obtained according to the pro
visions of this Ordinance
SEC Applications for license
under this Ordinance shall be made
in writing to the Mayor and shall
state where the business is to be
carried on the kind of business the
full name of the applicant and if a
firm the full name of each member
thereof
SEC 3 On the granting of such
license and payment to the City
Treasurer for the use and benefit of
said City of the sum of two hund
red and fifty dollars the Mayor
shall issue a license to the applicant
to carry on business in the place
named in the application for a
period of three months as a liquor
dealer to sell vinous spiritous and
fermented liquors at wholesale and
retail and by the dram to be drank
on the premises if so specified in the
application
SEC 4No license granted under
this Ordinance shall be assignable or
transferable or authorize any per
son or persons other than those
named in the license to carry on the
business therein specified and no
person or persons shall carry on the
business provided for in this Ordi
nance at any other place than the
ene designated in such license Pro
vided That the City Council may
on application by the parties inter
ested authorize the assignment of
the license ova change in the place
pf business
VSEC 5The Mayor whenever in
his judgment the peace good order
or safety of the city or its inhabi
tants hall require it and on Mu
nicipalCounty or Territorial election
days Fourth of July Decoration
Thanksgiving and all Territorial
and National holidays may by pro
clamation forbid the sale giving
away or in any way disposing of
virious spirituous or fermented
liquors for any given period not to
exceed twentyfour hours at any
one tiIi1 and any person who shall
sell barter or give away any vinous
spirituous or fermented liquors in
contravention of such proclamation
shall on conviction be fined not to
exceed ninetynine dollars for each
offense any license to the contrary
notwithstanding
SEC 6Any person obtaining li
cen e under this ordinance shall b °
subject to the fullowmg regulations
He shall faithfully observe and
keep all ordinances ifi force in
relation to liquor during the per
riod of such license r he shall not
keep open his bar house or place

liquors after the hourlf 10 oclock I
pm or before the hour of tu o clock

and on the proclamation of the
Mayor for all liquor establishments
to be closed he shall discontinue
business during the period of such
proclamation He shall not in any
wise dispose of liquors to any per
son under sixteen years of age nor
to any person intoxicated nor to any
Indian he shall prohibit music
dancing drunkenness and all riotous
or disorderly conduct on his prem
ises Heshall not barter sell or give
away any spiritous vinous or fer
mented liquors on the first day of
I the week commonly called Sunday
except he be the keeper of a drug
I store and then only for medicinal
purposes on the prescription of a
regularly licensed physician and
any person violating any of the pro
visions of this section shall on con
viction thereof be fined in any sum
not exceeding ninetynine dollars or
be imprisoned not exceeding one
hundred days or both fine and im
prisonment
SEC 7If any person shall sell or
otherwise dispose of or keep any
house or place within the corporate
limits of tIlls city for the purpose of
selling or otherwise disposing of
vinous spirituous or fermented
liquors without first having ob
tained a license therefor as herein
provided he shall ou conviction
thereof pay a line of not to exceed
ninetynine dollars for the first
offense and if convicted of a second
offense a fine of pmetynine dollars
and be imprisoned not to exceed
thirty days and for each subsequent
conviction a fine of ninetynine dol
lars and imprisonment not to I ex
ceed one hundred days
SEC SAny person violating any
of the provisions of this Ordinance
for which no penalty is herein pro
vided shall on conviction pay a fine
not to exceed ninetynine dollars for I
each offense I
SEC 9 All ordinances and parts
of ordinances relating to the sale of
vinous spirituous or fermented
liquors in conflict herewith are
hereby repealed Provided the re
peal of such ordinances shall not
affect any rights accrued or liabili
ties for fines and penalties incurred
but all such rights and liabilities
may be maintained and enforced
the same as if said ordinances and
parts of ordinances had remained in
full force
