SAN DIEGO, July 13.—A. G. Spalding,
the baseball magnate, has been legis
lated out of his position as a member of
the Wan Diego county highway commis
sion by the board Of supervisors.
The board appointed Spalding, John
D. Spreckels and E. XX. Scripps members
of the county highway commission June
20, 131 **>. for one year. The commission
met not long ago and adjourned, after
declaring that by naming ' hem for a
year and malting no provision before or
at the end of that time for their suc
ceeding themselves the supervisors had
legislated them otit of office. The super.
visors met In a hurry and finally agreed
that they had elected the three for.two
years, but for some unaccountable-rea-
Bon the action had failed to appear on
the minutes as. it should.
Spalding refuses to consider this a
legitimate excuse, insisting on consider
ing himself no longer an official of the
highway commission. In a communica
tion to the supervisors today he said
that his colleagues are as one with him

Spalding said that he would be de
lighted to serve if the supervisors would
let him do the work of his office unham
pered, hut that, owing to their inces
lant interference, he had no very pro
nounced relish for the place.
