Thus Is demonstrated tbe proposition that

posed of tbe original States alone; and on
every admission of a new State into this
Union, from that day to this, the distinctive
existence of such union and sorerelgnty of
the confederacy styled The United States of
Araerlcs has not only been distinctly recog

Jurisdiction, which made Us government

power derived under It, whether done or pur

Tbe acquisition bt foreign territory, and
tbe creation or nCw States out of It, was the
first ominous exercise or a powr euftfce of

gained no snch position or relations In the
Union as the original and constitutional
new States held In it. Tbey derived neither
their origin nor their Ufo from It, and hence
they became the pregnant elements of dis
integration. Tbey were the mere creations
of tbe Congress which secured their alle
giance to the Constitution by prescribing
and fixtngcertaln fundamental conditions to
their stateshlp la the Union, and thereby
reserving tho correlative powsr to remand
them to a territorial condition should they
undertake to annul, or viols te, or Infringe
on an entirely different footing la the Union,
from the original and constitutional new
State, vhlch wrt, as I have said, (As covtfifu
Hanoi Union, It was la the absence of snch
discriminating reference on either side, that
the antagonism which existed between tbe
executive and legislative branches of the
Government, under the late Administration,
seemed to the writsr to hare had their
origin, and I am apt to think that a proper
appreciation of this distinction would hare
gond far towards ending that antagonism,

mination our present complications, as well
as reconciling all differences between all
