FORMER HUSBAND OF ALICE THAW "BROKE" Lord Yarmouth Seeks the Protection of the Courts A Second Time TEDDY WASJHEERED Hailed Next President by Boston Crowd. LONDON. Dec. 14 At the public ex amination at the London bankruptcy court of Lord Yarmouth, who failed In July, his statement of affairs showed ranking liabilities of .18,526 and as sets of 57, absorbed, however, in the payment of preferential claims. Lord Yarmouth admitted a pre vious failure in February 1900. With liabilities 5,111, a composition of 10 shillings In the pound was then paid and the proceedings were annulled. The money was provided by his father, who had previously paid his debt in 1894, and in return the debtor as signed to his father certain of his in terests in the family estates. After 1900 Lord Yarmouth went to New York, where he was engaged as an actor and received an allowance of 300 a year from his father. In 1903 lie married Miss Alice Thaw, and under the marriage settlement receiv ed an.annuity of 1,100, but that ceas ed upon the annulment of the mar rtage In 1908. The allowance from his father was insufficient to cover his ex penses. In 12907 he fell into the hands of money lenders. In 1910 he wrote and produced a musical comedy called The Pigeon House," which was net a access, and he lost between 1,200 and 1,500. The present failure was largely due to extravagance. Lord Yarmouth; when asked how he expected to meet the liabilities creat ed on the promissory notes, replied that he hoped to pay them when he came Into the family estate. Gabriel a steam fitter, was shot in the abdo men and probably fatally wounded ear ly today by Policeman Max Schmidt of the Central station while the latter was on his way to report for duty. The robbers, who had held up eight men during the night, attempted to rob Schmidt, who was in his uniform at the time, when they say him at Bel mont and Lincoln avenues. Nesbit's poem is entitled "Gillilan." aad follows: CHICAGO'S COOKS ASK TEN HOUR WORK DAY (National News Association) CHICAGO, Dec. 14 New Years eve has been decided upon as the hour of a strike for shorter work-days and more varied diet by all the cooks' un ions represented in downtown hotels, if the hotels and restaurant managers refuse to listen to their complaints. French chefs, German kochen, Spanish cafetereaes and plain Ameri can cooks have united to demand a ten-hour day and a six-day week, or let downtown Chicago resort to home cooking on New Years' eve. The men assert that cooking, instead of being a fine art, has been reduced to the worst form of drudgery. They have to work from 12 to 15 hours a day and seven days a week, and in some instances are compelled to eat what they cook. SUICIDE IN NOTE ADMITS COWARDICE DEFENSE III PRICE TRIAL JMII BLOW Man Who Saw Avery Murd ered Said Victim Didn't Speak to Price. (Palladium Special) EATON, O., Dec. 14. Leslie Sam uels, considered the most important witness in the case of the state against Charles E. Price, charged with second degree murder for the death of An drew F. Avery, was called to the stand Wednesday afternoon. Samuels and a brother, William Samuels, were in company with Avery on the night of the tragedy and had planned to return home with him. On the stand he testified that he had seen Price com ing east on Main street and heard him say something to Avery, but that it was not sufficiently audible as to be understood. He also testified that he saw Price strike Avery with the axe handle and saw him fall to the ground. According to John Risinger, one of Price's attorneys, Samuels testified at Coroner Quinn's investigation that both Avery and Price said something to each other. His statements Wed nesday were a denial of this, he hav ing stated that Avery said nothing to Price. H. swore that Avery had been drinking a little, but was not in toxicated. With the conclusion of the testimony of Samuels, the state announced that its side of the case would be rested. The defense immediately made motion that the prosecution be compelled to call to the stand Wm. Samuels, who had been subpoenaed to testify for the state. Not beif g convinced of the legality in sustaining the motion, this being the first time in the history of the state's courts that such a question has arisen, Judge A. C. Risinger took the matter under advisement and will decide at Thursday morning's session. Price's wife and little daughter are in attendance daily and are seated near him. (National News Association) CINCINNATI, Dec. 14. Clarence Binkley, a 19-year-old church worker and Sunday School teacher, committed suicide by shooting. In a . note he wrote: "As a member of a church 1 confidently expect damnation for all these sins. I have tried to stand the storms of life, but I have not the backbone. ASK UNCLE SAM TO HUNT MISSIONARIES (National News Association) LEXINGTON, Ky., Dec. 14. Rev. J. W. Hardy of this city has received word of P. M. Rains of Cincinnati, sec retary of the foreign Christian Mission ary society that he has appealed to Secretary of State Knox to institute inquiry in an effort to discover the fate or whereabouts of Rev. W. M. Hardy of this city and Rev. J. G. Og den of Carlisle, together with three other missionaries who have been missing in Northern China for three months, and who it is feared, have been murdered by revolutionists. The last letter was written by them the last part of September when all were preparing to flee their stations be cause of the pillaging and murder.
