Now that the house of represen
tatives has killed the bill to abolish
special courts and all measures look
ing towards the creation of addi
tional judicial circuits, the adminis
tration of justice in the State will
continue to be handicapped by de
layed trials, necessitating special
courts and special judges. It seems
that the measures seeking to give
relief from over-crowded dockets
were favored by a majority of the
members of the house but the ma
jority could not get together on
any one measure, and the State

resentatives of the present con
gress, which,it will be remembered,
convened immediately after the ad
journment of the session preceding.
It is reported that "argument or
the point of order that the item wa!
not authorizad by law, turned or
the question of whether this was
the second session of congress, o1
merely a continuation of the session
convened November 9, on the call
of the president." The point was
made during the discussion that
there was nothing to warrant the
drawing of mileage for traveling
3,ooo miles during the period that
the clock was striking 12.
All of which was very well. Tak
ing a strictly legal view of the
question the senators and the rep
resentatives would no doubt have
been justified in accepting the mile
age. The law made no provision
for the case in point, where one
session was merged into another.
It would have been an absurdity,
however, for the members to accept
mileage on their trips home and re
turn "while the clock was striking
twelve." But it would not have
been as absurd as President Roose
velt's recess appointments. The
one would have been legally justi
fied. It is yet to be seen whether
there is even any law to justify an
appointment made in the interim be
tween two sessions of congress, one

revenue. The tax commission has
reported a bill to lay a license tax
on all corporations one-half of one
mill on the capital stock of all do
mestic corporations and three mills
on the gross earnings af public util
ities, such as railroads, teliphones,

will bring in sufficent revenue to
meet the expenses of the govern
ment with a five mill levy and in
five years pay the deficiency which
now amounts to about $4oo,ooo.
It is virtually a license tax. The
money from~ this source will be
paid directly into the state treasury.
While the Senate is wasting a
day each year looking after the
shad in the rivers, the members of
the House might profitably take a
day off and look after the lobsters
