Damages for Fire Children Killed.
In May, 1881, live children of F. H.
Nohrbrts of San Lorenzo, Alameda
county, were returning home from a
May-day pic-nic In a light wagon, and
when tliov reached a crossing of the
Central Pacific Railroad the vehicle
was struck bv a locomotive and nil the
inmates were killed. The father of
the children sued tho rairoad
company for damages. On tho trial
it was shown that the approaching
train could not be seen from the
highway until closo to tho crossing, on
account of ti bridge aud eucalyptus
trees. It was also shown that tho train
was behind time, and rnnning from
thirty-three to thirty-live miles an
hour, the usual speed being twenty
live miles an hour. Tho jury awnrded
$10,800 damages to tho plaintiH' and
defendant took an npneal. The su
premo court has affirmed the Judg
ment, holding that "in view of tho
rule of damages prevailing hero we
cannot ue reasonably expected to nom
that for such a loss as tho plaintiff In
this case sust.iined, the amount
awarded him by tho jury was ex
