Congressman Sherleys Bill
Passed
Washington Feb 8 The House
Saturday afternoon passed the Sher
ley amendments to the bankruptcy
law after unsuccessful efforts had
been made on the part of several
Congressmen to have the entire
bankruptcy law repealed
The amendments passed by the
House provide that any moneyed
business or commercial corporation
excepting railroads or banks can
file a petition in bankruptcy This
eliminates one discrepancy which
formerly existed many corporations
being barred from filing a petition
in one circuit because of court deci
sion but could be admitted to bank
ruptcy in another
One of the most important fea
tures of the amendment is that com
position proceedings will not be nec
essary to have an adjudication where
composition is effected This re
moves the stigtpa of bankruptcy
which formly attached itself under
former circumstances It also pre
vents a few creditors from forcing
by involuntary proceedings debtor
into bankruptcy and then having
the petition dismissed without the
knowledge of other creditors whose
claims have not been folly satisfied
One of the main provisions of the
bill relates to the preference of
claims and bars a debtors discharge
in bankruptcy if the creditor can
prove that preference on the pay
ing of claims was given
Mr Sherley in his address in I
favor of the measure stated clearly
that the provisions of the bill were I
not such as to provide an avenue of 4
escape for debtors

not want a rate lower than those
figures
