nals of priz and it is then responsi
ble to all foreign nations for tho cor
rectness of the decisions therein made
So far as the property in question is
concerned tho sentence in tho prize
court is conclusive upon all the world
It the sentence is one of conderana
nation tho title of the formor owner
is divested and all nations aro bound
to respect the new titlo acquired un
der it But to give the decision of
tho court this effect it must appear
conclusively that the court had juris
diction over the property in question
It sometimes occurs that circum
stances will not permit property cap
tured at sea to bo sent into port The
eaptor in such a caso may destroy it
or allow the master or owner to ran
som it
The property of a subject or an
ally engaged in commerce with the
enemy is liable to capture and it
makes no difference whether the trade
be direct or indirect Tho law ot ua
tions permits vessels to sail and chase
under false colors but not to fire a
gun or capture under them It has
b come an established principle of tho

certain privileges to ono of the belligerents-

States Tho 10th Ejection of the act
of June 30 180t provides as follows
The net proceeds of all property con
demned as prize shall when tho l rizo
was of suporior or of equal force to
tho vessel or vessels making the cap
turo hi decreed to the captors and
when of inferior force ono half shall
bo decreed to the United StateB and
the otfier half to tho captors provided
that in case of privateers and letters
of marque the wholeshall be decreed

adjudged to tho captors shall bo dis
tributed in the following proportions

twentieth pait ot all prize money
awarded to any vessel under his com

ron on duty under the orders of the
comman in chief of such fleet or squad

of any prize monoy awarded to a vea

made while unde his command the
said fiftieth part to be deducted from
the moiety due to tho United StateB

from tho amount awarded to tho cap
tor provided that such fiftieth part
shall not be in addition to any share
which may be due to tho commander
of the division and which he may

single ship making or agisting in tho

of the fleet or cquadr6n in which ho
is serving except in caso wbero the
capture is made by the vessel on board
of which ho is nerving at the time of
such capture and in such case he
shall share in proportion to his pay

board such vessel as is hereinafter

of a single ship ono tenth part ot all
the prize money awarded to the ship
under his command if such ship at
the time of the capturo was under tho
command of the commanding officer
of a fleet or rquadron or a division
and three twentieth if ha ship was
