The Powers Case
A News writer recently had the
JJ privelego to call on Mr Caleb
Powers who is confined in jail at
Georgetown charged with com
plicit in the murder of William
I Goebel and to have a talk with
him concerning his confinement
r
and his trials Mr Powers ha s
n confined in jail for eight
years and after the recent trial
o before special Judge Morris in
c which there was n hung jury was
refused bail In this trial ten of
i the jury were for acquittal one
I was for conviction and the other
would have agreed to a verdict of
acquittal if the remaining eleven
could have agreed So it may be
seen that it wasthe judgment of
eleven men that was offset by the
I f judgment of one man in the mo
tion for bail
IThe friends of Mr Powers are
now circulating petitions for his
pardon and the people of the com
monwealth will be called upon to
< request the Governor to exercise
executive clemency in his behalf
The petitioners will include wo
men of the State who desire to
a join in the request to the Gover
nor and the entire Stato will hare
an opportunity to join in the pee

Taking the history of the case
into consideration and the strong
I political alliances that were made
t against Mr Powers at the time of
his confinement in jailand since
the confinement and the hatred

and prejudice and partisan feeling
that has been heaped upon him
during these past eight years it
j seems little short of a miracle that
Ahe could have survived it aUand
to see him now with an indomit
able hopeful spirit still expectin

j and looking for relief in the end

behalf shows him to be a most re
markable man with utmost faith

It seems that the people of the
State should pity him in his help
less position and join the great

all the hatred and malice and prei

Wolfe Circuit Court
Court convened at Campion
Monday with n good crowd in at
tendance Judge Riddcll being
unable to be present ahd preside
on account of illness Governor
Willson appointed Fudge G W
Stone of Leitchlield Special
Judge who arrived Monday about
10 a in and proceeded at once to
organize tho court His instruc
tions to the grand jury were force
ful and to tho point imprcssinjr
upon them the importance of going
nt their work in n business like
alone dould
way and that they
originate prosecutions in the cir
cuit court for crimes committed
in tho county Ho dwelt at length
on the evils of the blind tiger and
the boot logger and their baneful
influence on the boys and young
men of the community
Jude Stone informed the mem
bers of the bar that ho was there
for business and that ho would try
nil the cases civil as well as crim
inal they could get ready oven if
it took the whole three weeks term
We were present the first two
days and tho business of tho court
was ground out rapidly and satis
factorily there being about 180
daysi
docket and nearly as many on the
second day

of which have been there for
years Tho way the judicial mill
is grinding at Campton these dock
ets will be largely cleared up this
term Judge Stono is n rapid worker
and is losing no time in dispatch
ing the business of the court
Repeal of Dog Tax Law
Senator H H Smith of Knott
county has the distinction of be
ing the first to introduce a bill in
tho State Senate for the repeal of
the unpopular and infamous Dog
tax law Tho following Is a oom
plete text of his bill
Section 1 That on act entitled
An act to promote tho sheep in
dustry and provide n tax on dogs
approved March 1st 1900 be and
same is hereby repealed
SEC 2 All taxes collected un
der said act sendnot disbursed
shall be refunded to the persons
paying same The fiscal courts ol
the various counties shall audit
the taxes so paid and issue vouch
erS itiTTrororoto the taxpayer
who may have paid their taxes
and upon presentation of same t °
the Auditor of Public Account
he shall draw his warrant on thE
Treasurer in favor of such tax >
payer or his personal represents
tires for the amount so paid into
the treasury If the tax collected
under said act has been disbursed
to sheep owners in any county
then to the extent it has been sc
disbursed there shall be a pro
drata diminution of each taxpayers
warrant as allowed by the fiscal
countye
Sec 3 Where the sheriff has
collected said taxes but has not
paid them over to the Treasurer
ho shall return same to the tax
payers from whom ho had col
lected them in the proportion
collected from each
Sic 4 Where said tax has not
been collected it is hereby excused
and remitted
