When H C Cross receiver of the Mis

Henrietta in the evening for the purpose of
conferring with parties relative to securing

the Texas and Pacific yards A consulta

ing of ground for the erection of a freight
depot and other terminal facilities Noth
ing was said slxrat this feature of the visit
in The Gazette at that time for the reason
that publication at that tinio would have
greatly Increased the price of property and

learned yesterday however that the price

of property is higher than the receivers de
sired to pay and the deal is off It has
been the custom of the gentlemen who -were
engineering this deal to blame Tub Gi

abortive but in this case the skirts of The

broucht up in good shape well ballasted
and now permits the running of trains on
faster time required by the new schedule
The closing of the eating houses and the
running of dining cars and buffet sleepers
eliminates the long stops for meals and
greatly rfacilitatcs the shortening of the

in a day or so
A Thousand Dollar Sale
City Passenger and Ticket Agent Davis
of the Fort Worth and Denver was feeling
highly elated yesterday and all because he
had sold eight throusrh tickets to San Fran
cisco and return at 12o each or 1000 for
the entire lot The purchaser was G W
Williamson a banker of Wilmington N C
who is accompanied by his wife sons and
daughters This is a pretty good days
work especially when the day was Sunday
at which time ticket agents have little to
do
No More Passes
Labor leaders are considerably agitated
especially those in Kansas and Colorado
over a decision of the Trans Missouri pas
senger association cutting off the passes
heretofore issued to the heads of labor or
ganizations They now speak of the rail
road officials as being haughty and cruel
liailroad men are very reluctant lo speak
of the matter They assort the roads are in
no sense under any obligations to these
men and that in many cases the holders
are using the passes constantly while engi
neering a strike arid that in case of any
trouble with employes the leaders were
the ones to do all in their power to widen
the breach instead of endeavoring to
heal it
A Knilroinl Humor
It is rumored in the Eastern papers that a
combination is on foot by which the Van
derbilts and the Burlington lines will
coalesce This will give the Vanderbilts a
continuous all rail route from the Atlantic
ocean to Denver It is also stated that the
same combination will absorb the Missouri
Kansas and Texas The Fort Worth and
Kio Grande is said to be a Varderbilt road
Should this report prove true connection
between the Uio Grande and the Missouri
Kansas and Texas could easily be made
here in which event the Rio Grande would
be pushed forward to Topolobumpo without
delax At Topoiobampo is said to be the
finest natural deep water harbor on the Pa
cific coast This would give the Vander
bilts almost an air line from Chicago to

Sweetwater Tex April 23 1S91
Editor Gazette
In the Daily Gazette of the ISth there
appeared an unsigned article from Fisher
Fisher county entitled Law in Fisher
County The authgr of the article in com
menting on the famous charge to the last
grand jury of Fisher county delivered by
Judgo Cockrell makes a bitter and unwar
ranted attack on Hon William Kennedy
judge of the Thirty second district and in
order to serve his purpose more effectually
misrepresents and slanders some of the
best citizens of his own county In order
to understand the matter it may be well
enough to state that in the reorganization of
the Thirty second district in 1SS9 Fisher
county was taken out of Cockrells and put
in Kennedys district by the legislature
where it remained until the legislature
again transferred Fisher county back to
Cockrells district by a law lately passed
and that in 1SS9 a petition numerously
signed by the best citizens of Fisher county
requested the legislature to make the change
then and that when the people of the
county learned that to suit the political
purposes of our representatives at Austin
Fisher county was about to be put back
again in Judge Cockrells district they got
Mr li C Crane a young lawyer of Robyj
who has an unimpeachable character and is
one of the best citizens of the county and
was signed by over 200 citizens of the
county the majority of whom were the best
known property owners and law abiding
permanent settlers With this statement
of the circumstances we now quote a por
tion of the article that appeared in The
Gazette
The charge to the grand jury was plain
and very much to the point The fact is
Judge Cockrell doesnt talk through his
nose nor read his charge from leugtliy
newspaper clippings till the jurymen fall
asleep and the hangers on go out for recrea
tion The result is that the crim
inal classes and their lawyers fear Cockrell
which accounts for his opposition in this
country A petition gotten up by a lawyer
quietly circulated and signed by a few of
his associates and their clients with a lot
of names of respectable men added gen
erally without their knowledge or consent
was sent to Austin protesting agaiust the
change and asking to be kept in Judge
Kennedys district In this way our county
was taken from Judge Cockrells district
three years ago and transferred to Ken
nedy and the law abiding element grieved
then as they rejoice now And if Cockrell
believed as ho spoke yesterday he has
been deceived by surface indications for
the permanent settlers and taxpayers see
the dawning of a better day And the
judge can be well assured that nine tenths
of the permanent settlers of Fisher county
rejoice over the change and that he will
hear no responsive echo to the groanings of
jack leg lawyers or their criminal clients
when the judges 400 pounds avoirdupois
comes down heavily upon them And that
he will find many and staunch friends on
avery hand to second every effort to put
down all manner of crime
Now we have no criticism to make on
Judge Cockrell who as far as we know is a
Christian gentleman an honest judge and
a good lawyer nor have we any comment
adverse or otherwise to make on the
action of leading citizens of Fisher
county in first petitioning to bo
taken out of Cockrells district and
later protesting against being put back
in his district for the office of district
judge is an elective one and the people hav
ing had no opportunity of expressing their
preference at the polls certainly should not
be criticised for exercising the right of peti
tion besides there are good reasons for
their action apart from and having no
reference to choice of judges Now as f ar
as the attack on the signers of that peti
tion and protest and on Mr Crane is con
cerned they are able to defend themselves
but Judgo Kennedy is our judge and we voted
for him and the base and false imputations
contained in this libel not only re
flects on him but also on the good people
of the Thirty second district Judge Ken
nedys character where he is known needs
no defense but Tiie Gazette has a wide
circulation and for the base and slanderous
charges contained in said article to go un
challenged might do him great harm where
he is comparatively unknown Judgo
Kennedy is an able and upright judge and
is the peer of any district judge in the state
and while we dont want to draw any in
vidious comparisons yet we invito
the readers to an examination of his re
cord in the court of appeals reports and
you will find that he is rarely ever reversed
at all and never on his charge to the jury
and while he treats all who have business
before him whether they be lawyers
parties to suits citizens generally or de
fendants charged with crime courteously
and gentlemanly and defendants fairly yet
criminals in his courts had much rather
monkey with the business end of a buzz
saw than to try to unduly influence him in
their favor Of course we know that Tun
Gazette would be the very last paper in
the state to do Judge Kennedy or any other
gentleman an injustice intentionally and we
believe that if The Gazette had been at all
conversant with the facts or the parties
the article would never have been published

chance to see the wheat country of Texai
their regular traffic but upon the assur
ance of this association that the whole
state ivould assist in matins the excursions
a success we have at last secured as liberal
a rate as any one could ask This is the
best season to bring people to Texas Kow
the opportunity is presented and while the
Texas real estate association will spare no
means in its power to bring thousands of
people to the state on the excursions yet
we expect every section of Texas to assist
The 2 cent immigration rate from all points
in the United State3 to Texas is also
available at all times
It is expected that other lines leading
into Texas will also make excursion rates
to the state Sincerely yours
