Constitutionality of the
Adair Liquor Law.
There 'seems to be an erro
neous impression abroad in re
gard to the decison of the
Supreme Court last winter un
der the Adair liquor law. It
has been frequently said in res
olutions and speeches in sup
port of the law as it now stands,
and in opposition to proposed
amendnieuts, that the Supreme
Court has decided that the
Adair law, or, more properly,
the Adair amendment to the
liquor law of 1851, is constitu
tional. This is a mistake. The
court ha3 made no such decis
ion, for tlio very good reason
that no such question bus been
presented for decision. The
Supreme Court at this terra de
cided three cases under the
liquor law ; one case under the
law of 1S51, one case in which
the questions were the same,
whether regarded as under the
law of 185-i or under the
Adair amendment; the third
under the Adair amendment
proper. In the latter case the
question was, whether a justice
the peace could take jurisdic
tion of an 'action against the
lessor of the premises where
the liquor was sold. The Su
preme Court decided against
the jurisdiction. In the other
two cases the Court was called
unou to cive construction to
certain provisions of the law,
sucn as me provision giviug u
riguc or acuou iur i"ju',y w
"means of suppoi t," to "person"
and to "property," etc. But
no question as to the constitu
tionality of the law lias been
presented to or decided by the
Supreme Court this .term, nor
since the December term of
1851, when Thnrman, Chief
Justice, announced the opinion
of the court, as then constitut
ed, holding that the penal sec
tions of the original liquor law
of May 1st, 1831, were not in
conflict with any provision of
the constitution.

in Newport, Ala., recently. A
woman wus found dead in her
bed, with a little child on the
body trying to open its moth
er's eyes.
