powering the Missouri, Kansas &
Texas Railway Company to Con
struct a Switch or Spur on Jack
son Streot, Acr. ss Tonth Strcot.
Bo it ordained by tho City Counoil
of the City of Waoo:
Spc. 1. That tho Missouri. KansaB
& Texas Railway Company, bo and it
is hereby authorized and ompowcred
to construct, maintain and opcrato a
switoh or spur connecting with its
switch or spur now running from its
main track from near the eastern
odgo of Tenth street to tho castorn
edgo of Elovcnth stroct, at a point
at or near the Western edge of Tenth
street; thoacc along Jackson street
and the property lino to tho westorn
edgo of tho alloy between Ninth and
Sec 2. Bcforo said Railway Com
pany shall bo authorized to construct
said spur or switoh it shall apply to
the oity engineer of Waoo and obtain
from him the propor grade of said
streot, and said track shall bo con
structed under the direction and
supervision of tho oity engineer, and
shall conform to tho grade given by
said engineer; and before said railway
company shall be pormitted to uso
said spur or switoh, it shall placo on
each sido of tho rails of said track,
whero tho same crosses or is laid in
said Jaokson and Tenth streets a
pieco of timbor two or mote inolies
thick and six or moro inohes in width,
and shall All in bctwoon the two rails
and botwoen tho main traok and tho
spur or switoh so oonstruotod, with
stone and gravel, as directed by tho
oity engineer, and grado Tenth streot
whero said switoh or spur crosses it,
bo as to mako tho surfaco of the
street lovol with tho top of tho rails
of said roads.
Sec. 3. It shall bo tho duty
of said railway company to
at all times keep said spur or switoh
and the main track in good repair and
woll ballasted with stono and gravel,
and it shall at no timo allow any cars,
ongincs orothor obstructions to oc
cupy or remain on that por
tion of said spur or switoh
whioh lies between tho main lino of
said track and tho outsido edgo of tho
sidewalk, along said Jaokson stioot.
Sec. 4. If at any timo said rail
way company shall fail or refuse to
keep said traok and tho Btreet between
tho spur or switch and the main track
iu good order, or shall fail or refuso
to repair the same when requested to
do so by tho oity marshal, or mayor,
or street commissioners of said oity,
then tho oity council may by a reso
lution adopted and sproad upon tho
minutes of eaid oity, revoko tho fran
chise and ropeal this ordinanco and
all rights, privileges and bonofits
granted said railway company herein
shall be withdrawn.
Sen. 5. This ordinanco shall
tako effect and bo in foroo from and
aftor its passage.
