Section. 1. Any ollioer of tho city
of Waoo, having tho legal custody of
iiporson acousoil or convioteil of a
mindeineatior who willfully permits
such person to rsoapo or to he res
cued shall bo lined not exceeding one
Sec. 2 Any officer of the City of
Waco having tho legal custody of a
porson Recused or convicted of a mis
demeanor, and who negligently per
mits such person to escape or be res
cued hhall be pimislieil by a lino not
oxct cding live hundred dollars.

process in his hands, requiring the
attest of a person accused of a misde
msanor, whereby tLo accused escapes,
or who willfully refuses to reooivo
into the city jail under his charge, or
to rcooive into his custody any por
son lawlully committed to such jail
on an accusation of a misdoinoanor, or
lawlully committed to his custody on
Kuch accusation, shall be punished by
a fine not exceeding tivo hundred dol.
Sec. -1 If any private person ap
pointed with his own consent to exe
cute n warrant of arrosit issued by any
propor officer of tho City of Waoo,
shall be guilty ol any one of the of
fenses heretofore enumerated in this
chapter, ho shall bo punished in the
.same manner as an officer in a like

or cause to be conveyed into the oity
jail of the City of Waco any dbguiHo,
instrument, arms, or any other thing
UBoful to aid any prisoner in escaping
with intent to facilitate tho oscapo of
a prisoner lawlully detained in suoh
jail, upon an accusation of a niisdo
meanor,ho shall bo finod not oxceeding
fivo hundred dollars.
Sec. G, If any person shall will
fully aid any prisoner to eHcape from
tho custody of an officor, by whom ho
is legally detained in custody on an
accusation of a misdemeanor, by doing
any act calculated to offoot that ob
ject, ho shall bo punished by a fino
not exaoeding five hundred dollars;
and if in aiding in tho escape, ho
make uBe of arms ho shall be pun
ished by a fino not exoecding one
Sec, ?. Tho offonsos onumorutod in
Articles or Seotions five and six are
oomplotd without tho aotual oscapo of
the prisonor; and a porson accused of
any of said offenses may bo prosooutcd
and tried, although the porsou escap
ing be retaken, and although aftor
being retaken ho is brought to trial
Seo. U If any porson in tho City of
Waoo shall willfully oppose or resist
an officer in executing or attempting
to oxeouto any lawful warrant for tho
arrest of another person, in caso of
misdemeanor or in arresting or at
tempting to arrost any porson without
watrant where the law authorizes or
requires the arrest to bo made without
warrant, ho shall bo punished by a
fine of not less than twenty five nor
more than fivo hundred dollars; and
if arms bo used, by a fine not loss than
fifty nor moio than one thousand dol
lars. Seo. 9. If any porson being oallod
on by tho mayor, marshal, or polico
offioer, shall fail or refuse to aid suoh
officer in any matter in which by law
he may be rightfully oallod to aid or
assist in tho oxeoution of a duty in
cumbent upon such mayor, marshal
or police officer, ho shall bo punished
by a fino not exoecding ono hundred
Sec. 10. If tho party against whom
a legal warrant of arrest is direotod in
a misdemeanor caso shall in tho City
of Waoo rosiBt its exocution whon at
tempted by any porson legally author
ized to execute the same, he shall bo
finod not oxeceding fivo hundred dol
lars. And if arms bo used in making
tho resistanoe, in such a manner as
would make him liablo for an assault
and battery or an aggravated assault
and baitery, he shall roooive tho
highest penalty affixed by ordinanco
for the commission of such offonBo in
Seo. 11. Accusation within the
meaning of tho ordinances of this
city, means a chargo made in a lawful
manner against any person that ho
has been guilty of some ollenso which

accused of an offense from tho tirno
that any criminal action shall havo
boon commenced against him. A
legal arrost without warrant, a com
plaint to tho mayor, a warrant legally
issued, are all cximplcs of accusa
tions, and a person prooeoded against
by either of these is said to bo ac
cused. See. l'i A porson is legally con
fined in jail or legally detained in
custody when ho has been committed
or arrcstod upon a legal warrant or
artestcd in any of the modes pointed
out in the Code of Criminal Procedure
of tho State of Texas
Sec 13. Tho word jail means any
place of ootifinouioiit used for detain
ing a prisoner.
Sec. 1-1. By ollioer, as used in thi3
ordinance, is meant any peace officer
of the Oity of Waco, or any person
specially authorized b warrant to

Bo it ordained by the city oouncil of
the city of Waco.
Section 1. It Bhall bo hercaftor un
lawful for tiny person to solioit
pasicngers or customers upon tho
arrival of any train in this oity upon
tho platform of any railway cempauy,
or upon tho space between tho railroad
track and tho dopot buildings; or
solicit passengers or ciiHtoniors ut
suoh dnpot in a loud ot boisterous
Section 2. It shall bo unlawful for
any person having control or chargo
of a vehicle for the transportation of
passengers or baggago, or any porson
driving such vehicle while awaiting
otnployment at any railway depot
within tho oity, to bo or remain more
than throo foot from such vehicle.
Section 3. It shall be unlawful for
any person to refuso to pay tho faro,
horotofore established by ordinanoe,
after boing carried to his destination,
or place wher ho loaves such vehiolo,
when suoh faro is demanded by tho
drivor or person having such vehiclo
Scotion 4. Any porson violating any
provision of this orditiauoo shall be
doomed guilty of a misdemeanor and
on oonviction shall bo fined in any
sum not less than $5 nor more than

Requiring Scavengers to Perform
their Duties Between the Hours
of 10 p, m. and 4 a. m.

tho city of Waoo.
Scotion 1. That it shall be tho duty
of scavengers, and porsona ongagod
in scavenger work, to perform suoh
work botwoen tho hours of 10 p. m.
and 4 a. m., and it shall be unlawful
for suoh persons to do suoh work at
any timo oxcept as herein allowed.
Sec 2. Any porson violating any
provision of this ordinance shall be
doomed guilty of a misdemeanor, and
on oonviotion shall bo punished by a
fino of not lees than ifvo nor moro
than one hundrod dollars.
