Judge Turners Decision
The following is the decision
rendered in the District Court by
Judge Turner in the case of the
Cumberland Presbyterian vs th
Presbyterian Church in the United
States of America
In May 1906 the Cumberland
Presbyterian Church reunited
with the Presbyterian Church in
the United States of America The
basis of union being substantially
that the confession of faith of the
latter church as revised in 1903
should be the confession of faith of
the reunited church and the
name of the reunited church
should be the Presbyterian Church
in the Presbyterian Church m the
United States of America A part
of the Cumberland Presbyterian
congregation a Jefferson repudi
ated the reunion and a part ac
cepted it The latter part assumed
possession of the church house and
manse and employed a pastor act
ing for the Cumberland Presbyter
ian Church inthe United States of
America The part of the congre
gation which repudiated the reun
ion acting for the Cumberland
Presbyterian Church sued to re
cover the property claiming that
the union was void and that the
property was being diverted from
its original trust purpose The
property was deeded to certain in
dividuals in trust for the use and
benefit of the congregation of the
Cumberland Presbyterian Church
at JefferHon Texas
Negotiations for reunion beg n
in May 1903 at the General As
sembly of each church In May
1906 the General Assembly of
each Church declared that union
was effected Certaiu members of
the Cumbeiland Presbyterian Gen
eral Assembly who was opposed
to union withdrew from that body
and organized a General Assembly
of their own and transacted some
business The regular General
Assembly adjourned sine die to
meet with the Presbyterian Gener
al Assembly in May 1907 The
negotiations for union lasted three
years but I deem it unnecessary
to detail them They are matters
of history well known
From the above summary of
facts I make the following conclu
sions of law
1st In May 1906 the General
Assembly of each church declared
that union had been effected In
my opinion whether or not union
had been accomplished is an ec
clesiastic question The highest
authority in each church so held
This is binding on the civil courts
If I should be mistaken in this
then I hold that union has been
effected regularly legally and in
accordance with the procedure of
each church
2nd The Cumberland Presby
teriau Church did not hold this
property in trust for the purpose
of propogating a particular religi
ous faith
3rd If I am mistaken in the
second conclusion oi law and if it
did hold this property in trust for
the purpose of propagating a par
ticular religious faith then I hold
that there is such similarity in the
confession of faith of the two
churches that its adoption of the
confession of faith of the Presby
terian Church in the United States
of America is not such a radical
change of its confession of faith as
to operate a diversion of said trust
property and a forfeiture of the
same
4th I hold that the united
church the Presbyterian Church in
the United States of America is
the legal successor of the Cumber
land Presbyterian Church and is
entitled to this property
5th The Presbyterian Church
in the United States of America
being in possession of said proper
ty through the defendants and be
ing entitled to the same judgment
is rendered for defendants

Death of Ed B Jones
On Monday Jan 2lBt the death
of Ed B Jones took place at the
home of his brother C C Jones
after a lingering illness Mr
Jones had lived in Jefferson for a
number ol years and had many
friends His father was a leading
citizen in our city in its palmy
day3 He had assisted his brother
in his large grocery store as long
as his health would admit it De
ceased leaves a devoted wife
biother and sister to mourn bis
loss to whom we extend sympathy
The funeral took place Tuesday
morning at 930and was conducted

The celebration of the one
hundredth anniversary of Robert
E Lee was held at assembly hall
Saturday night Jau 19th by Dick
Taylor camp and the U D C
The program was carried out as
published in last issue and from
first to close it was well rendered
by each one who took part in it
but special mention must be made
of the eulogy of Dr Clopton and
the song Tenting on the Old
Camp Ground by Mr and Mrs
C A Stutz and daughter Miss
Charlie and the little girlswho
sang Dixie The stage was ap
propriately decorated with Confed
erate Hags red and white bunting
evergreens and flowers It was an
occasion that will long be remem
bered by those who attended
Four veterans who had not re
