again un heard and put aside by subordi nate officers these officers as suming thatthe people whose rights have beenignored are un acquainted with the7 facts and surroundings and know nothing btthecause of their complaint itbVcomes necessary thatr Ihe people appeal to a higher au thority hoping that all wrongs heretofore done them may be righted and the great financial losses sustained by reason cf such negligence may in a meas ure be returned by a prompt righting of the wrong Feeling that this city county and the country the beneficia ries by the improvements of Cypress Eiver including some thirtyodd counties containing at least 500000 people have been and are being greatly wronged by the continued neg lect of Cypress and Eed River below Shreveport belieyingthis the Commercial Club of this city have determined to appeal to you believing that you will not submit to any injustice being done anyone or any section of the country if the facts are hon estly placed before you This club disclaims all intention of impugning the motives of any one or doing anyone an injus tice yet such a grevious wrong has been done this section of the State by the neglect of the en gineer in charge of this depart ment and that the club is forced to appeal to you for proper in vestigation as to the cause of this continued neglect andinjury done the navigation of Cypress River Senator Flanagan of Texas March 3 1875 made the follow ing statement I propose to amend on page 15 by inserting at the end of line 340 for a con tinuation of the improvements of Cypress Bayouin Texas 50 000 be continued saying That the legitimate and really the recom mendation of the officers of the government was some 312000 but I had no idea that the Senate would be so liberally disposed or I should have contended for 300 000 but I thought if I could get 50000 I would be gratified and still shall be if the Senate will pass it It would seem that had the gentleman understood the situa tion he could have gotten what Was recommended by the Gov ernment officers 312000 Evi dently they were justified by the commereein then making the recommendaton January 5 1885 Capt Eric Bergland made the following re port In compliance with let ter to Maj A M Miller corps of engineers dated Office of the Chief of Engineers United States Army Washington D C July 31 1884 and the require ments of the river and harbor act of July 5 1884 I have the honor to submit the following report on the examination of Cypress Bayou and the lakes between Jefferson Texas and Shreveport La made for the purpose of ascertaining if the necessary improvements can not be made upon some other plan than building a dam across the Albany Flats as recommended by the engineer It would seem that the engin eer had recommended a dam across Albany Flats yet for some cause and at the instigation of some one a plan was called for to seen if some other plan could be found than the one suggested Why was this done Again Capt Bergland says under same date A report upon the Examination Cypress Bayou was sent to the department by Major Miller hwith letter dated August 11883 In this report the amount esti mated for the necessary improve ments was given at 19000 In order to ascertain whether any important changes had occurred since the examination in 1883 I directed Assistant Engineer Burrows to make an examination and submit plans and estimates for improvement His report which is submitted herewith describes in detail the existing obstructions to navigation the estimate for removing these and the benefits to commerce that may be expected from such im provements Your special at tention is directed to this re port Capt Bergland continu ing says It is estimated that an expenditure of 16000 will secure safe navigation between Jefferson Tex and Shreveport La fpr a seven eight month each yeai f Yet a previous recommendation had been made fotf a dam t Albany Fats He fupther says As 94000 has Heretofore been ap propriated for this improvement I would recommend that the amount required fie Appropria ted He further says No work has been done on Cyp ress Bayou since 1880 witlf exception of the removal of a few leaning trees in February 1884 Mr Burrows iri > his1 report of December 1884 says Through dut Twelve Mile Bayou which has a length of 11 or 12 miles there is neverlessJjhan feefc of water at tha fowe age It from 30lTto Has a wlHftrvarying 400 feet Continuing he says From the head of Twelve Mile Bayou to Albany Flats the chan nel contains all the water during a low stage and is merely a con tinuation of Twelve Mile Bayou being 200 feet wide from 4 to 6 feet deep having a strong cur rent In order to reciaim and im prove navigation through the lakes Major Howell submitted in 1874 a plan for the construction of a highwater dam and a cut from Albany Point on SodaLake to Gold Point on Red River making the outlet from the lakes into RedRiver instead of through Twelve Mile Bayotf as at pres ent As the surface of the wa ter at Gold Point in Red River is 6 feet higher than the surface of the water in Soda Lake at Albany Point the object was to gain the advantage of this extra elevation across the shoal water in Soda Lake This plan would undoubtedly solve the problem of navigation through the lakes but its great cost estimated at 372580 has proved thus far an insurmountable obstacle to its adoption We will now quote from the internal commerce of the United States for the year 1891 Speak ing of the Erie Canal Mr J C Brown statistician of the New York Produce Exchange says The Erie Canal cost 51000 000 and the State expends on it 720000 a year in keeping it in repair but it effects a saving of over 4000000 a year in freight charges on the wheat alone that goes into New York City to say nothing of five times greater weight of other freights going into and out of that city The money is certainly well spent He says The 4000000 sav ing was not on the wheat that went into New Yorkthrough the canal but all that went into the city by railroad also Thus you see it is not only the saving the country makes on the products that pass through the waterway but on the railroads touching the water points We submit the proposition that had Major Howells plan submitted in 1874 to give this section of the State at a cost of 372580 navi gation been accepted and the work completed the saving to the peopie alone on cotton would have fully reached 500000 since then In this estimate no calcu lation is made of other merchan dise The freight receipts at this place by the railroads aver age nearly 200000 per annum or nearly 5000000 since 1874 twentytwo years ago A con seruative estimate of 35 per cent on all other merchandise would have been saved had we had navigation This is assum ing that no increase of business would have taken place yet everyone knows that the busi ness would at least have doubled Mr Brown further says It is not necessary that the water line should carry the freight to cheapen the rate It cheapens what it does not carry as well as what it does In short it regu lates rates on all lines of carri age that converge at a common point with it Your attention is respectfully called to the fact that the engin eers acting under instructions from someone have it appears to us systematically destroyed the navigation of Cypress River for first one pretext and then another The water of upper Red River has been shut off so that no water from it can enter the lakes as nature provided that it should The first and most disastrous step taken by your Department was the removal of the raft which was natures dam to protect the navigation of Cy press River and we dare say protect Upper Red River also In engineering as in chemistry nature is the most skillful We desire to call your atten tion to the fact that in the esti made for the improvement of Cypress River that no stress should be placed on the volume of business done by the river now for the reason that naviga tion for some cause has been de stroyed You should estimate period of the volume of business done pre vious to the destrustion of it and what would be done after its re storation Justice is one of the cardinal virtues so is restitution This section of the State has been wronged and at a cost of millions Wo appeal to you to have restored to us that which his been taken from us The flimsy excuse that large bodies of land has been redeemed by the stopping up of Red River is absurdity itself There is too much unoccupied land in the United States to squander mil lions of dollars in excessive freights for such a purpose We submit that if the Mississip pi JRiver was dammed at the rfiouth of Red Riverv aml the water of that stream forced through Atchafalaya into the Gulf the city of New Orleans would soon become a victim of the greed of the railroads and would not long exist Your De par tmen has shut out our sup ply of water and not offered to give us any relief in place of it Your engineers answer our ap peals for help and restitution Your commerce does not justi fy the expenditure Congress has been importuned by numer ous petitions from all over north ern Texas asking that naviga tion be restored in Cypress River If the Government will restore to us the navigation we had we will furnish the commerce In this section of the State there is is a very large and un developed iron industry This industry you understand re quires large quantities of coal and it must of necessity be cheap Alabama is now putting her coal on the Mississippi River at Greenville With ample naviga tion in both Cypress and Red River this coal could be barged here at a nominal cost Can this interest be developed before you give us the water Again the product of this iron plant can be marketed by water Can we do it unless you restore us thenavi gation we had Navigation would save to the people of north ern and central Texas thousands of dollars in freight on coal alone We notice that streams of less importance than Cypress Bayou and Red River receive large ap iropriations while ours gets a 10000 appropriation with 5 000 unexpended for a resurvey and perhaps adverse report because the commerce does not justify it For this reason as before stated we have been rob bsd of our water privileges No better time than now could be selected to remove the stumps logs and snags that would other wise obstruct the navigation The club has called Major Willards attention to it but as yet nothing has been done We submit that these small appro priations making surveys will not increase our prospects of getting the improvements so much desired Navigation in Cypress River is practicable and feasible so says Major Howell and we think Major Benyard also Then why not have an appropriation suffici ently large to do what is neces sary to complete the work It will certainly be admitted by every one with any legal knowl edge that even the Government has not the right to destroy the peoples highway to the markets of the world Restitution must be made when called on This is we understand the common law The club trusts that the Department will see the justice of our cause and see that the great wrong that has been done this section of the State is at once or as soon as practicable righted We have endeavered to place the matter before you in an im partial way and without any prejudice to anyone We have stated the facts as we under stand them We have made this more voluminous than we in tended yet we can only plead in apology the justice of our cause and the earnestness of the 500 000 people that demand that the restitution they deserve be made and the grevious wrong done them be righted Kindly make a thorough inves tigation
