owed and on which Skelton obtained
judgment and was finally compelled to
garnishee Mauds wages owing to him
from the R G W Ry company by
which company Mr Maud is employed

Power is suing for is 1092000 for ma
licious prosecution He was arrested
in Yernal Uintah county on May
14 1893 on the charge of malicious
mischief in poisoning a race horse be
longing to the defendant lie was ac
quitted and now claims damages for
injury to his reputation and loss in bus
inss Caldwell is represented by S K
King and Sam A Kng S R Thur
man and J W N Wmecotton appear
for the plaintiff Very much time is
taken up by the attorneys in the case
arguing what is and what is not proper
evidence hnd once or twice the wordy
wars have become quite animated and
both teams of lawyers have accused
the other of unprofessional practice
The defense of course aims to show
that the original complaint was flied
in good faith by Mr Caldwell and after
ha had sufficient Knowledge to make
Him conscientiously believe he had a
good case against Powers Of course
this information was obtained by
Ualdwell trom others and it is very
hard to get hearsay evidence before a
iury Tnurnian and Whitecotton are
patting in their best licks for Powers
and are determined that the best view
of the case for him only WIll get before
the jury and the two Kings are work
ing equally as enthusiastically for
Caldwell

brought a return to the belief that crea
tive design was supreme

several divisions of the convention that
the latest discoveries and theories have
been presented A year ago the biolo
gists who Lad believed for years that
they were on the point of solving the
mystery of life acknowledged them
selves baffled Now Professor Schaefer
president of tho action of physiology
announces the discovery in each tiny
animal cell containing life of what he
terms an attraction particle It should
be remembered that when the biologists
discovered the cell principle life they
chought it impossible to subdivide these
infinitely small atoms but the micro
scope has shown tho existence of this
email particle in each cell which is
itself a structure sui generis having a
leQuite existence and a definite function
< > its own It is almost as minute an
object as it is possible to conceive In
a cell which is magnified 1000 diame
ters the central particle appears merely
of tho size of a pin point Yet this al
most infinitely small object exerts an
extraordinary influence over the whole
cell which may be many thousand times
its size It initiates and directs those
processes which result in the multipli
cation of cells and indirectly therefore
it is concerned in directing the general
growth of the individual and ultimate
ly tho propagation of species It if
shown then that the principle of life
is contained in a particle 1000 times
smaller than the smallest object which
the best microscopes of a few years ago
were able to perceive and the latest
name for the unsolved mystery of life
