The Board of County Commis sioners of Canyon County, Idaho, met at 10 o'clock a. m. pursuant to adjournment from yesterday. All members of the Board being present when the following proceedings were bad: > In the matter of the appointment of a County Physician, it appear ing to the Board that said office vacant, Dr. W. E. Waldrop having agreed to accept the same according to the terms and con ditions of the contract which ap pears on page 55 of Book 3 of Commissioners Minutes, therefore, on motion, said Dr. W. E. Wald rop is hereby appointed County Physician for the balance of the year 1905, and ordered to file bond as required by law. All members being present when the following proceedings were had: In the) matter of Road District No. 8. In the determination of line between D. O. Mackay and others, it is hereby ordered that the County Surveyor be instructed to make a survey of the disputed public road and to determine the same, and before such survey to to notify all interested parties to appear upon the day of such survey In the matter of the petition of C. J. F. Peterson et al, for a road in district No. 12, it is here by • ordered that July 12, 1905 at 2 o'clock p. m. be set for hear ing on the same, and the Overseer of said Road District No. 12 is hereby ordered to serve notice of the time and place of said hearing on each of the non consenting land owners, viz: John Lemp and the Oregon Short Line Railroad Company, and make and file his report showing such service before the July, 1905, meeting of the Board. In the matter ot the application of the Directors of the Payette Boise Water Users Association, Limited, for an appropriation to aid in furthering the reclamation of arid lands in Canyon County, Idaho,, it is hereby ordered that a warrant be drawn on the Current Expense Fund, in favor of The Payette-Boise Water Users Associa tion, Limited, for the sum of $250.00. In the matter of the application of E. H. Dewey for a quit claim deed of Fractional Lot 8 in Block 26, Young addition to Nam pa, Idaho, it appearing to the Board that Canyon County has no title in said lot, it is hereby ordered that the Chairman of the Board of Com missioners execute a quit claim deed to E. F. Schultz et al, praying for the establishment of a new road in Road District No. 22, on motion, laid over until the July meeting of the Board. In the matter of the petition of M. J. Devers, et al, praying for the establishment of a new road Road District No. 12, on motion denied. In the matter of the petition of D. E. Sabin, et al, praying that a public road be established in this County, 50 feet in width having its poiutsof beginning and termination, course and intermediate points as follows: Commencing at N. E. corner of Sec 17 tp 5 N R 4 W B M in said county, running thence due west on section line on north side of said sections 17 and 18 in said tp also along the sec line north of sections 13, 14 and 15 of tp 5 N R 5 W B M until it intersects with county road running along the N side of O S L R R right of way, ending at the intersection of said proposed road with the county road running along the N side of said right of way where the same crosses the north line of sec 15 tp 5 N.R 5 W B M. It appearing to the Board that the proposed road would be of great public benefit, whereupon the Board ordered that F. J. Kiesel be award ed $125.00 as damages, and that a Warrant be drawn on the Road Fund for said amount. And the Overseer of Road District No. 11 is hereby ordered to open said road and put same in condition for travel. In the matter of petition of Henry Cox, et al, for the abandon ment of a public road in Road District No. 13, on motion denied. In the matter of the petition of C. C. Draper et al, praying for the establishment of a new road Dist rict No. 21, on motion, laid over until the July meeting of the Board In tne matter of the petition of M. F. Taylor et al, praying for the establishment of a new road in Road in Road District No. 24, it appearing to the Board that all of the land owners have not filed written consent to the opening of the same, on motion laid over until the July meeting of the Board. In the matters of the petition of F. A. DeClark et al, praying for the establishment of a new road in Road District No. in Emmett, Idaho, on motion, denied. In the matter of the petition of G. W. Latnson, et al, praying tor the establishment of a new road in road district No.—, it appearing to the Board that said petition is incomplete and that no bond ac companies said petition, on motion referred back to petitioners for correction. In the matter of the petition of E. Waring et al, for an appropria tion of $90.00 for improvement on Freeze Out Hill, on motion denied. In the matter of the petition of E. E. Bradley et al, praying for the establishment of a new road jn road district No. 23, it appearing to the Board that said petitioners have not complied with the re quirements of law in that no bond accompanies said petition therefore, on motion, said petition is hereby referred back to petitioners. In the matter of the petition of J. M. Bowman et al, for a bridge over Eureka Slough, on motion laid over until July meeting of the Board. In the matter of the petition of H. C' Prescott et al, for a bridge over Ten Mile Slough, on motion laid over until July meeting of the Board. In the matter of the petition of G. E. Stone et al, for the appoint ment of Jos. A. White as overseer of road district No. 1, on motion, denied. In the matter of the petition of Tim Driscoll et al, praying for the appointment of Thos. Ireton as overseer of Road District No. 3, on motion, denied. In the matter of the petition of Henry Cox et al, praying for the establishment of a public road in Road District No. 13, on motion denied. In the matter of the petition of J. L. Watkins et al, praying for the establishment of a new road in Road District No. 11, fifty feet in width, having its points of be ginning and termination, course and intermediate points as follows: Beginning at the southwest corner of Section 32 T 6 N R 5 W B M, thence west to the public road that parallels the Short Line Railroad. It appearing to the board that the written release of E. B. Smith has been filed and that said report is now complete, therefore, on motion, petition is hereby granted, said viewers report accepted and the Overseer of said Road District No. 11, is heredy ordered to open said road and put same in condition for travel. Also a warrant ordered drawn on Road Fund for $32.00 in favor of P. E. Anderson, as damages, and to be delivered to said P. E. Anderson, when he files his written consent with the clerk of this board. In the matter of the petition of E. H. Dewey and others, praying for the construction of a Court House: This matter coming regularly on for hearing, and the board having considered the same, finds that the present Court Hours is inadequate to the needs of the Count; that the records therein contained are not safe from danger of destruction by fire; and that a necessity exists for the erection of a Court house, as prayed for: Said board further finds that said Court House can be ( C<mtinued to last page. )
