THE CAIRO AND VINCENN'ES ROAD.
Springfield, 111., Aug. 11. The Cairo
and Yiucenncs railroad is on the eve ot
emerging from the hands of the courts aud
receiver. For some time past the case of
Edward F. Win-slow vs. the Cairo and Yin
cennes railroad and endless intervening pe
titions, etc., have occupied the attention of
the United States circuit court
in this city. Late last evening all
of these intervening petitions were
disposed of. Quite a number were dis
missed. Tho receivers were ordered to pay
Biral Crawford the sum of $900 77 iu satis
faction of a judgment obtained against the
company for right of way. They were also
ordered to borrow money and issue certifi
cates of indebtedness bearing 7 per cent,
interest to pay the judgments obtained by
Green B.Raum and John W. Mitchell,
(amounting to about 18,000), and G5,000
to J. S. Morgan & Co. of New York. Also
to pay into the hands of J. A. Jones
the sum of $1,39543, which
is to be paid by him to
various patitioners, and the deposit is to
stand in lieu of the trust fund in the
hands of tho receivers, and to discharge
them trom further liability in that regard
After all these intervening petitions hai
been thus disposed of, J. W. Drexel and C
jc. iracy, trustees ana receivers, riled a pe
tition asking that they be discharged. Tho
petition recites that the trustees became
purchasers of the Cairo and Vincennes
railroad, under a decree rendered Novem
ber 39, 1879, for the benefit of the first
mortgage bond holders, the bonds amount
ing to $3,500,000, which purchase was con
firmed by the court, the same order direct
ing that they hold the road and property in
their possession as trustees for the bond
holders. The petition further shows that a
plan has been agreed upon between
them and the bond holders tor tho or
ganisation ot a new company to be
know as the Cairo nnd Vinronnna
Railway company, which shall issue its
common stock in payment of the $11,500,000
bouds, and $1,700,000 preferred stock, to
pay overdue interest aud receiver's certifi
cates. In pursuance of this affreenient tlm
new company has been organized, and a
Urge number of the bond holders agree to
take stock iu payment of the bouds. Tho
petitioners pray that they may be dis
charged from further duty; that the agree
ment be approved by the court, and that
they be directed to deliver the railroad am
property to the new company. Judge
Treat made tho order in accordance with
the prayer, and the Cairo and Vincennes
railroad will soon pass into the hands of
the new company. Hon. Samuel P.
Wheeler of Cairo represents the bond-hold
ers of this road.
