The suit of Memphis bondholders against
the state commissioner and receiver of back
tuxes for tliut city, after going through the
United (States circuit court up to the United
States supremo court, hag ended iu a result
adverse to the bondliofders. It will be re
membered that the city of Memphis
was disincorporated on tho ground thut
it was unable to pay its debts. It was
divested ot its niunicipial character
and made a mere tax district of the
state under the management of a commis
sioner. Rut the creditors brought suit
against the tax commissioner in the circuit
court ami obtained it decree compelling the
application of the assets of tho city, includ
ing all unpaid taxes to tho payment of their
claims, 'the court also appointed a re
ceiver and enjoined the tax commissioner
from interfering with the assets and taxes,
and it even went so far as to hold that all
private property in the district was liable
for the debts of the defunct municipality.
The supreme court undoes all this, and
decideg adversely to the creditors on every
point involved it decides, lirst: That what
is usually regarded assets of a city--parks,
public buildings, water " works,
fire engines and other similar property.
is uot subject to execution to satisfy judg
ments against the city for debt; that they
are public property of which the city is
only trustee, and cannot be sold for the
city a debts. Resides being public prop
erty, they arc necessary agents and ad
juncts of government, and for this reason,
also, they cannot be seized. .Second, tho
court desides that the propeity of indi
vidual citizens is not liable for the debts ot
the city, except through regular taxation.
The local laws in some of the New Eng
land states impose this liability on private
property, but the general law
of the country does not. Third,
the court holds that taxation is a legisla
tive, not a judicial function; the power to
assess, levy and collect taxes comes only
from the legislature, and cannot be usurped
by the courts nor be delegated by them to
any officer, such as a receiver or marshal.
These decisions embody important princi
ples of public policy, which have been fore
shadowed before and are now expressed in
definite form. Of course they defeat the
claims of the creditors of the former city of
Memphis, which is certainly a great hard
ship to them; but the case is one of the
many where debts are created which are
never paid, and where human laws supply
the creditor with no remedy.
