as would prohibit the C. V. It. It. Co.

In 1800, was a bonatldo contract with
the city and the Cairo & Vlncennea R. R.
Co. Ia said ordinance the right ot way
was granted to tho C. &, Y. R. H. Co. to lay
down and opurate a railroad track on and
along Commercial avenuo to such point aa
the said R. R. Co. might build and locate
their passenger depot, subject to such rea
Bonable laws as the city council may direct.
Believing that the city council granted the
right of way ami the C. & V. It. R. Co. ac
cepted said grant we do not think the city
council has power to pass any ordinance
prohibiting the said company from operat
ing on said street in any part of the day or
night. We admit that the city council has
the power to regulate tho running and
apeed of trains. Tho legislature in their
judgment has seen tit to pass a law allow
ing the different railroads in this state
to run their trains through cities and
towns at the rate of ten miles an hour for
passenger and six miles for freight trains,
l'hut the city council of cities can pass an
ordiuance in conflict with that law is a
question that cnu only be decided in courts
of the state. We are of the opinion that
ten miles an hour is too ;reat a speed to
run a train through tho city, and it tho city
council can pass a legal ordinance making
it six miles, it would, in our judgment, be
more satisfactory. We must, however, ho
governed by tho laws of the state and we
would not recommeud any ordiuuuees to
be passed in conflict with them. Your
committee beg leave further to report that
wo nave patiently listened tor several hours
to attorneys on both sides of this ques-

the city council can pass no ordinance
prohibiting the right granted by the city to
the O. & V. R. R. Co. And that the ordi
nance presented to the city council and re
ferred to your ordinance committee June
7th is not such sn ordinance that the city
council could legally pass.
