The Law3 of Livery,
Differences between the livery stablo
man and tho hirer of tho horse are very
frcqu'-nt, and generally, though the
owner of the horse may get pecuniary
rodress, it is the poor bruto that mostly
suffers. To ride or drive a borrowed
or hired burse to the devil has become
a comtnen saying. One or two recent
English cases are worth commenting
upon, as showing that that very much
abused person, the livery stablo keeper,
has certain rights.
A man hired a horse and carriage at
Ipswich, with the understanding that bo
.would drive to Colchester and return
the same day, a distance of twenty
miles each way. The person who had
the horse and vehicle drove not only to
tho place specified, but to & town ten
miles further on working tho horse
sixty miles within the specilied time of
hiring. Tho horse died next day. Tho
veterinary surgeon was of the opinion
that the animal had been overdriven.
The defendant's counsel arguod that
the agreement was to drive "through"
Colchester, but ihe jury did not think
bo and the plaintiff won the case, with
a verdict of 21, the value of the horse.
Deviations from a fixed route between
two places, when a horse is hired and
injury is sustained by tho livery keeper,
mav bring a penalty on the hirer. Be
tween New York and a place called A
the distance may be thirty miles, and
the livery stable keeper knows the dis
tance. Rut if the hirer takes round
about ways to reach there, increasing
tho distance traveled, knowing tho
proper or shorter road, he is, unless ho
has specified to a go-as-you-pleaso
method of journeying, liable to dam
ages. As to daniasres to vehicles, so
constant with awkward drivers, it
would bo quite wise if a tariff' of charges
were put up iu livery stables. Then a
man would know 'beforo ho started
what his rig was worth.
