Peruns sion to appeal from the decision of the appellate department of the supremo court preventing the destruction of the ballots cast in the Inst city election was denied to Mayor McClellan by the appellate division today. MINE TRAGEDY AT D Young Miner Drops Down Fifty-flve Foot Shaft and Body Blown to Pieces by a Shot from Which He "Was Try lng to Get Away, Chris Loss, a young man 19 years of ago and n son of Peter Loss of Cnsn Grande, was killed iu what is known as the House mine belonging to the Comp ton Copper company, thirty miles south of Casa Grande, Wednesday night of last week at about 11 o'clock, sas the Florence Blade. The deceased young man had been employed at the mine for some time, but his work had been on top of the ground at the mouth of the shaft until the night of the accident, when he had exchanged places with a Mexican employed in the shaft. Tlds shnft was. fifty-five feet in depth and was being sunk with the assistance of a gasoline hoist which a young Mex ican was running. When the two men iu the shaft gave the firing signal they told tho Mexican at the top of the shaft to ask the Mexican at the engine if. he understood the signal, and the reply whs in the atlirmntive. Jack Mc Kinuoii, who was the other miner iu the shnft, then spit the fuses and both men stepped into the bucket and the hoist ing signal was given. The bucket was n small ono nud the two miners had but one foot each in jt. When they reached the top, the engineer stopped about two seconds and then shot the bucket upward. McKinuon, by jumi ing, got out all right, but Loss dopended for a second or two longer upon the en gineer stopping the engine again in rcsjtousc to his yells, and then realizing the danger of being run up into the sheaves and knowing that his hold on the rope would be broken and ho would be dashed to the earth or down the shaft, he let go his hold on the rope and attempted to jump, but the bucket swung out from under him and he fell hend first down the shnft. McKinnon tried to grab him as he went down, but having scarcely regained his own bal ance after leaping out ot the bucket, he did not reach far enough to fasten onto the clothing of Lohh, but did catch his cap. Had he caught hohl of Ioss he would undoubtedly have gone down tho shaft also, but when he missed his hold ho listened Jong enough to hear the body strike the bottom of the shaft with a dull thud and to ascertain if there was any found of life from the man below, and hearing none, he or dered the engineer to lower the bucket, but the latter had run the bucket up into the sheaves with such force that it was stuck there and before it 'could be loosened so much time had elapsed that it would have been sheer madness to have attempted the rescue of the body which was McKinnon 's idea aud tho otlicr man nt the shaft con vinced lfiin of this. McKinnon Jhen ordered that the bucket be lowered to the bottom of the shaft so that in cne Loss was able to get in he could do so. but when the bucket had touched the bottom of the shaft he held the rope so as to feel if there was any movement; below, but there was not ami iu but a few seconds the charges went off, blow ing the remains of the man in the shaft in two and mutilating them so badly, they had to be gathered up iu a sack.
