department of justice, suit has been
filed in tho second judicial district court
of Albuquorquo by tho United States
against tho Pennsylvania Development
compnny, tho Now Moxico Fuol k Iron
company aud "V. S. Hopowell ns terri
torial ugont of the corporations, to can
col tho deeds to nonrly 10,000 acres of
valuablo timber land in Valencia coun
ty, secured by tho dofondauts in 1001.

It is alleged by tho government that
tho lands in question wero secured by
tho defendants from tho board of public
lands of tho torritory by fraudulent
means, aud that tho territorial ofliciuls
and tho defendants wcro both aware
that tho transaction was mado in viola
tion of the provisions of tho act of
congress granting public lnnds to the
torritory, and providing for tho salo of
such public lands for the benefit of ter
ritorial institutions.
It is asked that the defendants bo
enjoined from furthor cutting timber
off tho lands, and that thoy bo com
pelled to roimburso tho territory for
tho value of timbor already taken from
tho tracts.
Judgo Ira A. Abbott has issued an
order directing the .dofondauts to ap
pear in court and show cnuso why an
injunction should not issuo restraining
them from longer laying claim to the
promises or cutting timber off tho land.
It is alleged thnt W. S. Hopowell as
agent of AVillinm II. Andrdws, presi
dent of tho Snntn Fo Central Railway
company, and tho two companies, ne
gotiated tho purchaso of tho lands for
tho defendants. Knowing that only a
quarter section of the lands could be
sold to ono person, tho defendants en
tered into negotiations with tho torri
torial board of public lands for tho pur
chase of 10,000 acres of vnlnnblo timbor
lands in Valencia county. Tho public
land board at that time consisted of
Governor Otoro, Solicitor General Bart
lott and Commissioner of .Public Lands
Keen. Three dollars an aero was of
fered for tho lands.
Tho application was mado by William
11. Androws by his agent, W. S. Hope
well. It is alleged that whilo this ap
plication purported to bo for Androws,
it was made in tho interest of tho Penn
sylvania Development company. A meet
ing of tho land board was held to con
sider tho application, and tho applicant
was notified that tho land could not be
sold oxcept in tracts of 160 acres.
However, this did not deter tho ap
plicants, for it is alleged that thoy then
ontorcd into a delibcrato schemo to
defraud and to evade the provisions of
tho law by going among tho stockhold
ers of tho Pennsylvania Development
company and tho Santa Fo Central
Railway company, and the friends, rela
tives and families of tho ofilcors of the
company, and persuaded forty-nino per
sons to sign applications for 160 acres
each, and that theso applicants were
then asked to deed over tho land to tho
corporation, which thoy did. It is al
leged that the commissioner and the
board had full knowlcdgo when tho ap
plications wore mado that tho individ
ual applicants would turn over tho Innd
to the Pennsylvania Development com
pany, and thnt tfio board was aware
that tho schemo was fraudulent and
plnnncd to avoid the provisions of the
law.
The government declares that money
and promissory notes were paid over for
tho lands, not by tho individual appli
cants, but by tho Pennsylvania Dcvel
opmont company and W. S. Hopewell as
manager.
No contract in writing was executed
and no record for salo of tho lands to
tho defendants was ever mado on the
books of tho land board.
All payments, on the contrary, were
credited to tho forty-nino applicants,
nono of whom paid any money. The
defendants knew when they wcro pay
ing $3 an aero for tho land in ques
tion that it was covered with Valuable
matured pino forests, worth as much as
$100,000 and upwards.
Tho plaintiff asfis that tho deeds to
tho development company and also to
tho forty-nino applicants bo canceled;
that tho defendants bo mado to give an
accounting of all timber cut, and be
made to pay all tho profits and benefits
accruing from tho lands.
Tliis suit is tho second to be filed
within a few weeks, tho first being
against tho American Lumber company,
tho Rio Grande Lumber company and
Clark M. Carr, and involving 50,000
acres of valuable timber lands, alleged
to havo been acquired in a liko manner,
and in which the government seeks to
cancel tho deeds on the grounds of
fraud and conspiracy.
Tho filing of this second suit
strengthens the belief that at tho recont
conferences had in Washington between
tho president, Attorney Gcnoral Bona
parto and E. Payton Gordon, assistant
to tho attornoy general, that instruc
tions wero given to continue with rc
nowed vigor tho lnnd frauds investiga
tion, which was begun in New .Mexico
early in tho spring.
Moro sensational developments are
oxpected soon, as it is rumored that
complaints will bo filed charging certain
mon of prominonco with perjury in
connection with tho frauds alleged to
havo been committed. Agents aro now
collecting cvidenco with this ond in
viow, it is believed, which will spin a
wob around certain corporation heads
that they will not bo able to throw off
connections with tho alleged frauds.
