trict Attorney Oeorgo Purdy BulIarA
this morning received a letter from At
torney General E. S. Clark in regard to
tho recent dispute between tho board of
supervisors of Maricopa county and tho
lessees of school lands.
Attorney Gencral Clark upholds Mr.
Bullard 's opinion in every instance,
Some of tho lessees claimed that since
they had never paid any rentals for
their lands they did not have to do so.
The board started in to collect all back
rentals, but met with resistance.
District Attorney Bullard decided
that tho board had a perfect right to
collect theso back rentals, The law
states that if any lessee cannot raise
tho money immediately he may be
granted thirty days' time upon nppli
catlop, If ho does not pay up and does
not request tho month's grace, his land
may bo rented to anyone else.
Mr. Clark upholds tho validity of this
statute. Ho recommends that tho entire
question bo settled amicably, without
any lawsuit or other trouble, as soon
ns possible. This is the desire of the
Mr. Bullard also requested an opin
ion upon the validity of chapter 52,
laws of 1907, This gives thp Tempo
Normal school the right to take over
and" control section 16, townshjp 1 north,
range 4, which is school land hlthorto
controlled by tho board. General Clark
thinks this entirely constitutional. There
is nothing to prohibit tho legislature
taking land out of tho control of the
board and putting it directly into tho
hands of tho normal school board.
