THE CLARION OPELOUSAS, MARCH 3i, 1906. THE APPROPRIATION FOR PUBLIC EDUCATION. State Legislature to be Asked to Give for the Next Two Years as Much from the State as is Given by Parishes and the Towns and Special Taxes. The Baton Rouge Tl'rutll tells us that it is reported on rehliable au thority that the report of the State Superintendent of Public Educa tion, which is now being made up, showing the educational progress for the past two years, will contain a recommendation to the State Legislature asking that the State make an appropriation for educa tita purPol lthat w-ll- vqua- the appropriation that the schools re ceive from other sources. The State Superintendent of Education will ask the General As sembly to appropriate for the pub lic schools for 1906 and 1907 amounts equal to the appropriations from the Police Juries and the towns, the local school taxes and the Individual contributions to the public schools during the past year. The statistics that will be given out in a few (lays by the Educa tional Department will show a re markable growth of the schools during the past year, and a healthy sentiment for better schools throughout Louisiana. Bayou bhicot Dots. March 27.-Capt. T. C. Gibbens, of Washington, L. E. O. Bennett, of Oakdale, and Luther I). You hg, of Turkey Creek, visited us last Wednesday. Mr. nloberly, engineer of the Louisiana East & West railroad, was in town during the week. "Meta," you know it rained in torrents all last Sunday-you know it did. Well, that explains it all to you. Capt. Cox, manager of the Plum merville saw mill plant, visited Mississippi last week. Mr. H. L. Erlich has a good house, lawn, kitchen, stable, etc., plenty fruit during the summer, such as figs, plums, pears and peaches, which he will rent to any one wishing a desirable and pleas ant summer residence. It is with In three hundred yards of the post office, and fine fishing all summer within 6 or 7 miles. The cold snap of ten days ago has caused a set back to gardens of at least two or three weeks. Mr. Monroe Wolff, a prominent planter and merchant of Lone Pine, was in town on Saturday. That's right, Bunkie. You are a town now. Deputy-Sheriff Fontenot is quite a busy man just now, serving jury notices, taking assessment, etc. And by the way, Maurice, what did you do with the two yards of pink sash ribbon you bought-of course you took it home? I just asked the question to get an item. At last, Jake, you are awake! But you are quite sleepy yet. Get a move on you, and let's hear more from you. If you are tired, or have that feeling, like we all have in the Springtime, just step around at friend n aul's,or Yorick's, and they will cure you. If I were as near them as you are I would never have that feeling. And by the way, you ought to boom up your town more than you do. Tatman, teacher of the Oakdale school, gave us a pleasant call on Friday evening, and reported his school getting along nicely. And now comes Mr. J. B. Sandoz with a three-story brick building, glass front, 60x95 feet, construction on which will begin on or about April 15th next. The location is the old Lavergne corner, across the street from Mr. Sandoz's main store. The entire building will be used for his own business-undertaker, buggies, im pliments, etc. He has already a large store and several warehouses, all of which he will continue using for his business. When the new building is completed Opelousas will be able to boast of the largest hard ware establishment in Southwest Louisiana. To carry out the purposes for which the Bayou Mallet and Plaquemine Drainage District is created, and to effectively drain the lands situated within the limits thereof. Provid ing for a special election of the property tax payers within said dis trict, qualified as electors under the constitution and laws of the Statl of Louisiana. authorizing the comnlmis sioners of the Bayou Mallet and Plaquemine l)rainage District to in cur debts and issue negotiable bonas to the amount of twenty-five thous and dollars, payable in 50 years from (late of issuance. And authorizing the commissioners of said Bayou Mallet and Plaquemine Drainage District to levy a special tax of five mills per annum on the dollar on all the property subject to state tax situated in said District, for a period of fifty years. Section 1. Therefore be it resolved, That a special election be and is hereby ordered to be held ion Tuesday, the 1st day of May, 1906, between the hours of 7 a. m. and 6i p. m. in said district, under the general election laws of this State .as far as applicable to take the sense of the property tax payers of said district entitled to vote under the laws and con stitution of this State, as to whether the commissioners of the Bayou Mallet and Plaquemine Drainage District shall be authorized to incur debts and issue negotiable bonds to the amount of twenty-five thousand dollars, in denom ination of five hundred dollars each, payable in fifty years, bearing four per cent per annum interest, for the purpose of draining the lands situated within the limits of said district as herein above set forth, and also as to whether a five mill tax shall annually be levied and collected for a period of fifty years consecutively, beginning with the year 1906, upon all the property situated within the limits of said district, sub ject to the State tax, and to meet the payment of said bondts as may be issued by the commissioners of said" District. Section 2. Be it further resolved, that the ballots to be voted at said special election shall be in the following form, to-wit: Those in favor of authorizing the Commissioners of said District to incur debts and issue negotiable bonds as hereinabove set forth and in favor of the special tax herein provided, shall contain the words: "For authorizing the Commissioners of the Bayou Mallet and Plaquemine Drainage District to incur debts and issue negotiable bonds to the amount of twenty-five thousand dollars, payable in fifty years, bearing four per cent per annum interest, and for a special tax of five mills on the dollar annually, for a period of fifty years, to be used in ef fecting the drainage of said district and to meet.such bonds as may be issued by the Commissioners of said district and interest thereon." And those against shall contain the words written or printed thereon: "Against, authorizing the Commis sioners of the Bayou Mallet and Plaque mine Drainage District to incur debts and issue negotiable bonds to the amount of twenty-five thousand dollars, payable in fifty years, and bearing four i per cent per annum interest, and against a special tax of five mills on the dollar annually for a period of fifty years to be used in effecting the drainage of said District, and to meet such bonds as may be issued by the Commissioners of said District, and interest thereon." Section 3. Be it further ordained, etc., That the Board of Supervisors of the Election of the parish of St. Landry is hereby requested to appoint commis sioners and clerks to serve at, the poll ing pliaces in said district, at said elec tion, to give due notice of said appoint ments, and of the time and place of hold ing said election, and to designate such polling places as may be necessary. Section 4. Be it further ordained, etc., That the commissioners of election shall receive the ballot of each voter, check his name, or-that of his principal, on the list of yoters furnished by the registrar, as having voted, enter and tumber his name or that of his principal of the list of tax payers voting, and immediately deposit his ballot in the ballot box, and that immediately after the closing of the polls tlte commissioners shall, in the presence of the bystanders. Droceed to open the ballot boxes, count tle votes in number and amount, make up in du plicate the tally sheets showing the votes in number in favor of and against the proposition submitted and showing the valuation of property in favor of and against same, making in duplicate com piled statements of the votes in number and amount both in favor of and against such proposition; that after swearing to the correctness of the numbered list of votes, the duplicate tally sheet and du plicate compiled statements, they shall deposit the ballots, the registrar's list of voters, the numbered list of taxpayers voting, one duplicate tally sheet and one duplicate compiled statement, in the ballot boxes, immediately seal up said ballot boxes and within forty-eight hours after closing the polls,deliver said sealed ballot boxes with their contents to this body through its president, and shall withih the same delay deliver the other duplicate tally sheet and other duplicate compiled statement to the Clerk of the District Court, St. Laudry parish, who shall file same in his office. Seotihr .7. ýie ittrhfrderordained, teim., That this Board shall meeton Thursday May 3, 1906, at the hour of 12 o'clock a. m.. to open in public session the ballot boxes, examine and count the ballots in number and amount, examine and can vass the returns, and declare the result of such election, which result th 3 Board shall promulgate by publication in one issue of the official journal; and the ballot boxes containing the ballots and other returns shall be carefully pre served by the Board for the period of six months. Section 6. Be it further ordained, etc., That at said election all duly qualified electors, who are property tax payers of said District, assessed for the year pre vious, including women property tax payers residing in said district, shall be entitled to vote, and that women voters shall have the right to vote in person or by an agent authorized in writing to vote for them; and it is further ordained that each voter's name shall be endorsed on his ballot, by himself, and that the ballots voted by proxy shall have en dorsed thereon the names of both of the taxpayer and her proxy; in case the voter is not able to sign his name it shall be done in the presence of wit nesses; and it is further ordained, that written proxies from women voters shall be attached to the ballot voted for them and deposited in the ballot box with said ballot. Section 7. Be it further ordained, etc., that if a majority in number and as sessed value of the property taxpayers of the said district, voting at such elec tion, shall vote in favor of such special tax, then this Board, on behalf of said district, shall immediately pass an or dinance levying a special tax of five mills annually for fifty consecutive years, beginning with the year 1906; and it is further ordained, that this re solution be publisned for thirty days in the official journal, and that the levy, collection, and paying over the pro ceeds of the special taxes to this Board be done strictly in accordance with law. Littell Mayor of said town, that pursuant to the requirements of the Charter of the town of Opelousas, same being act 136 of 1898, that there will be an election held in the town of Ope lousas, La., at the Court House, in said town. The polls to be opened at 6 o'clock in the forenoon and to be closed at 7 o'clock in the afternoon on Tuesday, April 17, 19o6. Said election to be held for the purpose of electing a Mayor, a Marshal and five members to constitute the . Bard of Aldermen of the town of Opelousas, to serve for the term of two years, or un til their successors are qualified. BAILEY, Clerk. o Dr. Pulford offered the following or dinance, which after having been read sectiion by section, on motion, duly sec onded and carried, was adopted as fol lows: A AN ORDINANCE An Ordinance to promote the public a health by prescribing the manner in a which water liable to breed mosqui toes shall be cared for within, the limits of the town of Opelousas. r Section 1. Be it ordained by the Mayor i and Board of Aldermen, That it shall be unlawful to set up, have, keep or main tain on any premises in the town of Ope lousas any cistern, tank or well that is not screened with wire mesh not coarser than eighteen (18) wires to the inch both ways, provided that the inlets and "out lets of such cisterns, tanks or wells may be screened in any manner or with any material approved by the Board of Health of the Town of Opelousas, that will thoroughly prevent the ingress or egress of mosquitoes to and from the water therein contained; provided, how ever, that no water seal shall be used in screening any such inlets or outlets. Sec. 2. Be it ordained, etc., That it shall be unlawful to have, keepor main tain on any premises in the Town of Opelousas, lot or batture, or in any ceme tery, park or square, any pond, pool, fountain, trough, urn or water receptacle of any similar character or kind, unless r the same is kept constantly covered with t kerosene oil from Feb. 1 to Dec. 1 in each year, or be kept constantly stocked with mosquito destroying fish, or covered with the protective netting specified in Section 1. Sec.8. Be it ordained etc., That it shall be unlawful between Feb. 1 and Dec. 1 in each and every year to have or keep on any premises water in any can, pitcher, bowl, bottle, tub, bucket, barrel, trough or other receptacle, unless the same be thoroughly emptied, dried or cleansed every five (5) days before being refilled; provided however, that fire bar rels may be maintained on premises. provided that they are properly screened with 18x18 wire mesh, but all fire buckets shall be maintained empty, Sec.4. Be it ordained etc., That it shall be unlawful to have or maintain on any -premises in the Towntt o pe lousas any open well, unless the same be con tinuonsly closed or screened as above provided, so as to prevent the ingress or egress of mosquitoes to and from the water therein contained and the draw ing of water therefrom be operated by pumps. See. 5. Be it ordained etc., That it shall be unlawful to have or maintain any gutter or drain or roof in or on which 1 water stands after rains, without drain ing off thoroughly. Sec. ei. Be it ordained etc., That it 1 shall be unlawful to have, keep or main- 1 tain on any premises in the Town of I Opelousas any open cesspool or privy vault, to the liquid contents of which a mosquitoes have ingress or egress, un- e less the same be thoroughly covered with petroleum oil every fifteen (15) days from Feb. 1 to Dec. 1 in each and every a year. V Sec. 7. Be it ordained etc., That every lot or square in this city which in the judgment of the Board of Health is near enough to the houses of its inhabitants 1i on which water stands in pools or ponds '1 or which contains excavations or holes a or depressions in which water may ' stand, is hereby declared a menace to public health, and the owner thereof who shall fail, after notice by the Town a Board of Health and within the time a therein prescribed, to fill or drain the sl same or keep it covered with petroleum oil, shall be deemed guilty of a violation of this ordinance. Sec. 8. Be it ordained etc, That it shall be unlawful to set up, have, keep or maintain in any house or hotel water closets furnished with a tank or basin with water seal, unless such tanks or a' basins be emptied and the water therein s renewed at least once in five (5) days, from Feb. 1 to Dec. 1 in each and every year, or be kept during same period thoroughly covered with kerosene oil. Sec. 9. Be it ordained etc., That the Town Board of Health shall cause this ordinance to be enforced in all its pro visions, and to that end said board or persons acting under its authority shall have the right any time from 9 a. m. to 4 p. m. each day to enter upon premises, lots, squares, parks or battures, and any person charged with any of the duties imposed by this ordinance failing, after notice by said Board of Health and with in the time prescribed by said notice, to perform said duties, shall be deemed guilty of a violation of this ordinance. and for each day after the expiration of said notice the party notified fails to comply with said notice shall be guilty of a separate violation of this ordinance, provided, however, that no notice from the Board of Health or its officers shall be required to hold any person liable to penalties for the violations of Sections 1, 2, 3, 4,6 and 8 of this ordinance, the pro visions of which sections are declared to be self operative and imperative; but in cases unduer those sections where screen ing has been improperly done originally or where the screening has gotten out of order, or has been injured and ren dered defective without the knowledge of the owner, or if absent, his agent, then the penalties shall be imposed only on failure, after notice, to make the neces sary changes or repairs. Sec. 10. Be it ordained etc., The owners, and in their absence, the agents of mniers of llit premises, lot, squares, arks or bhattures in the Town of Ope louss, shall be liable for violations of the provisions of Sections 1, 4, 5 and 7 of this ordinance, except in cases where, without the knowledge of such owner or agent the tenant of or trespasser on any premises, lot, square, park or bat ture shall violate the provisions of this ordinance, in which event such tenant or trespasser shall be liable for such violation ; where the premises are vacant or are occupied jointly by the owner and his tenants or sub-tenants, the owner or in his absence, his agent, shall be liable for violations of Sections 2, 3, 6 and 8 of this ordinance. The tenants or occupiers of all premises, lots, etc, shall be liable for violations of Sections 2, 3, 6and 8 of this ordinance, and in the case above provided, for violations of Sections 1, 4, 5 and 7 thereof. Sec. 11. Be it ordained etc, That any person who shall violate any section of this ordinance shall be punished by a fine of not more than twenty-five (525) dollars or by imprisonment for not more than thirty (30) days, or both, in the dis cretion of the Mayor.
