Be itfurther ordained, etc, That twenty per centum (200) of the total amount assessed against each property owner as hereinbefore set forth shall be payable in cash, and the balance shall be payable in five (5) equal annual installments, bearing interest at the rate of six per centum (6%) per annum from date of acceptance of said work; provided, however, that any prop perty owner desiring to pay the entire assessment in cash, or any portion there of before maturity, shall have the privilege of so doing. Section 3. Be it further ordained, etc., That in default of payment of said prop erty owner or owners of the assessment herein levied against them, or any part thereof, the City attorney shall im mediately proceed by suit to enforce payment in the manner provided by Section 4, of Act No. 147 of the General Assembly of Louisiana of the year 1902. Section 4. Be it further ordained, etc., that the Clerk of the Board of Alder men of this city, be and he is hereby di rected to cause the above assessment and ordinance to be recorded in the mortgage records of the Recorder of the Parish of St. Landry. Section 5. Be it fuather ordained, etc., That the Mayor of this city be and he is hereby authorized to issue in the name of the City of Opelousas, La., five (5) certificates of indebtedness, each for the sum of fifteen hundred and sixty nine and73-100 dollars (1,569.73), for the purpose of covering the deferred pay ments due on account of said sidewalk construction, said certificates to bear interest at the rate of 6 per cent per an num until paid, and to be dated as of the same date as the adoption of this ordi nance, the payment of said certificates to be securedby the special assessment herein levied, which said funds shall be available solely for the purpose of meet ing said certificates at maturity, in principal and interest, and for no other purpose. Section 6. Be it further ordained, etc, That the certificates of indebtedness herein authorized and provided for shall have annexed to them coupons for the interest payments, in the usual form, and these coupons shall be re deemed and paid upon presentation to the treasurer of the city of Opelousas, La., on or after the dates they respec tively become due. The form of the certificate of indebtedness herein au thorized and provided for shall be sub stantially as follows, to-wit: UNITED STATES OF AMERICA STATE OF LOUISIANA, CITY OF OPELOUSAS. No. $1,589.78 CERTIFICATE OF INDEBTEDNESS FOR SIDEWALK CON STRUCTION. Opelousas, La, June 25th, 1909. This is to certify that the City of Opel ousas, La, is indebted unto R. C. Huston in the sum of one thousand five hun dred and sixty-nine and 73-100 dollars, ($1,569.73), together with 6' per cent an nual interest thereon from date hereof until paid, payable to the order of said R. C. Hustou - years from this date, out of the funds derived from the special assessment levied by ordinance of the Board of Aldermen of the City of Opel ousas, La, of date June 25th, 1909, against certain property owners of said city on account of sidewalk construction abaut ting their property, the entire proceeds of which said special assessment are dedicated to the payment of this certi ficate and interest, and the other four certificates and interest, of this series, and being one-fifth part of the balance dne the said R.C. Huston on account of sidewalk construction as per his con tract with the City of Opelousas, La., of date March 16th, 1909, and of record in the office of the Clerk of Court of the Parish of St. Landry, La. The interest to accrue on this certi ficate from date until maturity hereof being represented by coupon- hereto attached, and which with the amounnt of this certificate are to be paid to the holder at maturity by cash warrant of the Mayor on the City Treasury, and out of the funds above described which have been especially appropriated thereto by ordinance of the Board of Aldermen adopted this day. Be it further ordained, etc, That these certificates herein provided for may have placed on theirbackthe following form of assignment to be used, if sodesired, by the contractor: This, certificate, and so much of the contract price named in the contract between the City of Opelousas, La, and R. C. Huston, contractor, for the construction of sidewalks in the City of Opelousas, La., under contract of March 16,1909, as is represented by this certificate, is as signed to the holder hereof and such holder is hereby subrogated to all rights to receive the amount named in this certificate, and is subrogated to each and every right existing under the ordi nance and the contract to enforce pay ment of same.
