JURY OF JEFFERSON DAVIS PARISH OFFICIAL MINUTES OF THE POLICE Mermentau Ferry Contract Transfer ed to 0. Myers. Sixty Days .. to Complete New Boat Je'nuings. La., December 2, 1920. The Police Jury of the Parish of Jefferson Davis, Louisiana, met in re gular session at the Court House in Jennings, Louisiana, on this day at 9 o'clock a. m. The meeting was called to order by Heon. C. E. Carr, president, and upon roll call the following members were present: . J. A. St. Germain, Ward 1. W. Krielow. Ward 2. J. M. Davis, Ward 3. J. S. Treme, Ward 4. D. E. Cole, Ward 5. C. E. Carr, Ward 6. A. E. Bourgeois, Ward 7. Dolzie Bourgeois, Ward 8. David Marcantel, Ward 9. The minutes of the regular session on November 4th, were read and ap proved in open session. The committee appointed At apre vious meeting to confer with the Police Jury of Acadia Parish in con nection with the Mermentau Ferry lease submitted a report, and after due deliberation an assignment of the Mermentau Ferry lease frcm L. Cart to 0. Meyers which was presented to the Poice Jury containing certain mo dificatlcns of the original franchise granted to the said L. Cart, was duly considered by the Police Jury and after due deliberation Mr. St. Germain moved that the said assignment to gether with the modifications of' the original tranchise therein specified be approtied-by this body upon the condi tion that the assignee execute a suit-I able bond as stipulated in the original franchise within fiteen (15) ays from this date, and with the further priviso that the assignee within sixty (60) days from this dateo build and have in operation a Qew ferry of the capacity and according to the specifi cations provided in the said original franchise. The motoin was seconded by Mr. Krielow and upon being put was carried. The assignment together with modi fications of the original franchise above mentioned as follows: "State of Louisiana Parish of Acadia. Know all these men by these pre sents, that , Leopold Cart, a -resident of Acadia Parish, Louisianat, for the consideration hereinafter stated does hereby transfer, assign, set over and deliver unto Oclide Meyers, a resident of Acadia Jarish all of my right, title and interest in and to a certain con tract ,entered into with the Parishes of Acidia and Jefferson Davis, being a privilege for the operation of the Mermentau Ferry located in the vil lage of Mermentau, near the Southern Pacific bridge, and operating between the said parishes. The consideration of this sale is the sum of Four Hundred Fifty ($450.00) dollars, of which amount Two Hun dred $200.00)' dollars is paid in cash, receipt whereof is hereby acknowledg ed and full acquaintance granted. there for, and the balance, Two hundred fifty ($250.00) dollars to be paid with in ten days, and in addition the said I Meyers assume the payment of Eight eenecertain promissory notes executed by me, each for $100.00 dated Septem ber 2, 1920, two due each year, begin ning September 2nd, 1920, 1991, the said notes being held by the Police Juries of Acadia and ,9ferson. Davis, Parishes, and forming part of the con sideration given by me to the said parishes for the said ferry privileges. Having purshased -from the Toler Lumber Yard, of Crowley, Louisiana, a;bill of lumber, amounting to about $622.00 for the construction of a new ferry boat, it is agreed that the said Meyers take over the said contract with the Toler Lumber Co., receiving the said lumber and paying freight thereon upon arrival thereof, and pay therefor $200.00 cash when %he said lumber is unloaded and the balance thirty days thereafter. It is distinctly understood that upon failure by the said Meyers to pay me the balance of $250.00 within ten days of this date, and in the event of his fai lure to receive the 1 umber purchased by me of the Toler Lumber Co., afore said, and make the payments, as above set forth, the transfer of the ferry privilege is forfeited, and I am to ex ercise ther ight to enter upon and tak possession of the said privilege. It' is further distinctly understood that the said Meyers shall assume all of the obligations of the ferry lease entered into with the Parish 'above named, furnish the bond required (thereon, and shall further consent to the following changes in the contract entered into with the said parishes, Ito-wit: Part E; of section two be amended to read as follows: The purchaser shall be bound to run or cause to run, during the hours hereinafter mentioned, a mctor driven ferry boat, the boat to be not less than 20 tons capacity, and capable of carry ing note less than six average size automobiles, and to be constructed in every respect safe and suitable for first class ferry service. Part F; of section two, to be amend ed to read as follows: The purchaser shall be bound to operate the ferry at all times, wind and weather permitting. Section three to be amended to read as follows: Be it further ordained, etc., that the maximum rates which the purchas er shall have the right to charge shall be as follows: From 1 a. m. o 12 o'clock noon, and from 1 p.m. to 5, p. m., all persons and vehicles, tiucl- and tractors, not herein after expressly included, shall be carried free, except Sundays, when maximum day rates shall be charged. Fromel2 noon to 1 p. m. and from 5 p. m. to 8 p. We have taken from each adjoining property thirty feet for right of' way on legal subdividing lines and have received the right of way from all land owners on said route. We recommend that the sum of One Hundred ($100.00) dollars be paid to Walter Todd for right of way over his lands, this being the estimated cost of building fences along the right of way, and we most respectfully ask that you adopt this report and grant us the said road. Latour The above report was submitted by Mr. Treme who moved that the same be adopted and approved and that the route as recommended be declared a public highway, and that the treasurer be authorized to issue a warrant on the treasury in favor of Walter Todd for the sum of One Hundred ($100.00) dollars as recommended in said report The motion was seconded by Mr. D. Bourgeois and upon being put was carried. Mr. Marcantel moved that the Presi dent of the Police Jury be authorized to place an order for dipping material for the year 1921, to be used in the work of systematic tick eradication. The motion was seconded by Mr. Bour geois and upon being put was carried. ORDINANCE NO. 159 An Ordinance establishing two vot ing precincts and fixing their boun dries in Jennings, Louisiana. The above ordinance was recom mended by the ordinance committee and upon roll call the same was adopt ed by the following vote; yeas, 9; nays 0; .The noon hour having arrived Mr. Cole moved that the Police Jury ad journ for noon until 1:30 p. m., The motion was seconded Mr. Marcantel and upon being put was crnied. Afternoon Session The Police Jury reconvehed at 1:30 o'clock with all members present. The matter of a permit of the public highway from the Town of Welsh to the Town of Lake Arthur for the pur pose of conducting an automobile race coming up and "after discussion Mr. Davis moved tfat the Police Jury de cline to- grant a permit to. use the pub lic highway for the said proposed, auto mobile race.
