Supreme Court, recently delivered in
tho ease of Samuel Chase rt vh.

stated by Judge Thornton in these
words :

Tlio chief of the "offences and mi.v
"conduct'' mentioned was the repeated
ominion, by iicv. .'1 r. Chcncv. ot the
word "regenerate" in' the pcrformanco
ofthe baptismal rite, ai rc'uired by the
ritual of the Kpi.copal Church. For
tliisoiiii'sion he was cited to trial.
Soon after tho commencement of the
trial by the ecclciastical Court, duly
convened by HMiop Whitchoute in
Chicago, .Mr. Cheney filed hi Hill
in Chancery and obtained an injunction
from ono of the courts in Chicago.
rcAtrainingtho Ecclesiastical Court from
proceeding with his trial, alleging that
the proceedings in tho cccle-iastical
court were irregular, and that a Court
of Equity could interfere to protect
him from the decrco of tho ecclesiasti
cal Court.
Mr. Cheney claimed that, although
tho canons of tho church do not pro
vide for a right of challenge to any of
the members of tho court who were to
try him, he had uch right as a citizen
under tho law ofthe land.
On this point tho language of tbo
opinion iMrong ami explicit. Juugo
Thornton, speaking for the Court, says :

Our law only, requires ono witnei, with
two exception!; tho tcriptural rule re
quire two. Thu Injunction of St. I'.tul U,
"Agalnit an cider reccivo not an accuia

Tho Inw under the old dispensation was :
"One witness thall not rise up against a
timn for any Iniquity, or for any sin'j at the
mouth of two witnesses, or at tho mouth of
threo wltncitw, shall tho matter bo estab
lished." AVohavono right, and, therefore, will
notcxorclsu tho power to dictate ccclusl
attlcul law. Wo do not aspire to become
dtacto heads of tho church, and, by con
struction, or otherwise, abrogate its laws
and canons. AVo shall not Inquire
whether tho alleged oml.ilmi Is any of
fense. This Is a question of ecclesiastical
cognizance. This Is no forum for .uch ad
Judication. The church should guard Its
own fold; enact and construe Its own laws;
enforce its own discipline; and thus will
bo maintained tho boundary between the
temporal nd spiritual power.

Tho minister, in a legal point of viow, Is
a voluntary niombor of tho association to
which he belongs. Tho portion is not
forced upon him j ho seeks it. Ho accept
it with all Its burdens and consequences j
with all the rulcJ and laws, and canons
then subsisting, or to bo made by compe
tent authority ; and can, at pleasure, and
with Impunity, abandon It. If they were
merciful and regardful of conscientious
scruples, he know It; If thov were arbi
trary, illiberal, and attempted so chain the
thoughts and consciences, he know it.
They cannot, in any event, endangor his
life or liberty; Impair any of bis ponsonal
rights; deprive bim olproporty acquired
undor tlio laws; or intorfero with
any tbo free exerciso and enjoyment
of religious profession and worship
for they are protected by

One ofthe grounds upon which Mr.
Choney's learned counael Bought to in
voke tho restraining power ofthe courta
was that by the action of the codec-,
siastical tribunal he won about to bo ,
removcd froBB the rectorship or Christ
Church, Chicago, by means of which
rectorship ho received a largo ualary,
and which he claimed to be a rested
richt. The Court make short work of
this "vested right" claim in these words:
It would be a mockery ofjanguago to
say tho agreement for aalary, thus made,
constituted a vested right a right which
could not bo suspended. Tho salary de
pended upon the continued performance
of tho duties of rector. Tbo contract must
be construed and enforced by referenco to
the canon which form n part of it. It
the minister was suspended or deposed for
any ecclesiastical oiicnco tne payrnen
would ceaio.
The views of the Court on the various
points of the case are sustained by very
numerous decisions in both English and
American courts which arc cited or
quoted by the Court.
After showing the error of the posi
tion" ffitimed by tho counsel for Che
ney, that non-confirming rector's cao is
lispofed of in tho following language :

from unhallowed tire." Tho ministers .o
lected to sit In Judgment on tho acts of a
brother ought to bo Impartial and compe
tent, prompted, as they doubtlftM are, by
tho teitchings of divine revelation, and tbo
kindly Influence! of Christian charily
which "Sutfercth long and I kind; bear
cth all things, belleveth all things, hopeth
all thing", endureth all things."
Having given this case a most careful
consideration, our deliberated Judgment I
that tbe ecclesiastical coutt ought not to bo
restrained by tho mandate of the court.
And fo in Illinois it is finally settled
that the civil courts will not interfere
with ecclesiastical tribuuals except
when rights of property aro being dis
turbed ; and tho high character of our
Supreme Court will oxtend the whole-i-oma
influence of this decision beyond
tho borders of the State.
Wo repeat that members of secret
societies will be interested peculiarly iu
this decision, because if an ecclesiastical
body may be restrained by a court of
equity, a lodgool Masons Jor Odd Fel
lows may bo enjoined from trying a re
creant member.

creased ; many valuable tuiues have been

operation lias been remunerative; agri
culture has kept pace with the domand
for produco, and it has been demonstra
ted that Arizona has locked up in her
rock-bound mountains vasts doposites of
tho precious metals, and that her grat
ing and agricultural recourses are, un
surpassed. With tho Indians tho people of tho
territory have had much trouble.
